This article shall hereafter be referred to as the "Snow and
Ice Removal Ordinance."
It shall be the duty of the owner, tenant or occupant of any
real estate in the City of Nanticoke to clear the sidewalks contiguous
thereto of all snow or ice within 12 hours after the cessation of
any storm which results in any accumulation of snow or ice on said
sidewalks.
If any sidewalk in front of any real estate within the City
of Nanticoke is not cleared by the owner, tenant or occupant as directed
in the previous section, the City may cause said sidewalk to be cleared
forthwith and shall immediately report the costs and expense thereof
to the City Manager. Said charge shall be collected against the owner,
tenant or occupant as other charges and assessments are by law collectible.
It shall be unlawful for any person to deposit, throw or shovel
or to cause, allow or permit any person or persons to deposit, throw
or shovel any snow or ice in and upon the traveled portion of any
such street or highway located in the City of Nanticoke.
The owner of a vehicle or the person in whose name it is registered
or the operator of said vehicle shall not allow, permit or suffer
such vehicle to stand or park in any street, way, highway or parkway
under the control of the City in such manner as to interfere with
the work of removing or plowing snow or removing ice.
For the purpose of removing or plowing snow or ice from any
public way in the City, the City police may remove or cause to be
removed any vehicle parked in such manner as to interfere with such
work referred to in the preceding section. The costs of such removal
and storage charges shall be borne by the owner.
No person shall deposit or cause to be deposited any snow or
ice on or immediately next to a fire hydrant or on any sidewalk, street
or highway or loading and unloading areas of a public transportation
system, except that snow and ice may be mounded by the municipality
on streets or highways incident to the cleaning thereof or mounded
on the curbs or treelawns incident to clearing of sidewalks in business
districts. Anyone hiring a private contractor to remove snow is responsible
for placing all snow onto private property.
Any person or persons, firm or corporation violating any of
the provisions of this article shall, upon summary conviction thereof
in a summary proceeding before the Magisterial District Judge, be
sentenced to pay a fine of not more than $1,000 and costs and, in
default of the payment of such fine and costs, be imprisoned in the
county jail for a period not exceeding 90 days. Each and every day
upon which any person or persons, firm or corporation violates or
continues to violate the provisions of this article shall constitute
a separate offense.
