Charcoal, burners, and open-flame devices such as propane-fired grills shall not be operated or stored on multifamily complex balconies, or be used within 10 feet of combustible construction, in any multifamily complex involving three or more units, except where buildings, balconies and decks are protected by an automatic sprinkler system. One- and two-family owner-occupied dwellings shall be excluded from this requirement.

As used in this article, the following terms shall have the meanings indicated:
Wood logs or commercially purchased logs.
Usually constructed of a terra cotta material with a formed stack and an opening for entering logs.
Usually a bowl or square type of metal structure with legs, grated sides and a mesh lid.
A.
Approved devices shall not be located within 10 feet of any combustible construction and must be placed on a noncombustible surface such as concrete, slate, etc.
B.
The Fire Official shall reserve the right to have said items extinguished upon determination that the described smoke creates a nuisance.
Any person violating this article shall be subject to a penalty of not less than $100 and not to exceed $5,000 under the provisions of the Uniform Fire Code of New Jersey.
