A code regulating the manner in which refuse may be stored, collected and disposed of; declaring and defining certain conditions as nuisances; fixing the responsibilities and duties of persons storing, collecting and/or disposing of refuse; and providing for issuance of permits to collect refuse is hereby established pursuant to the provisions of Chapter 188, P.L. 1950 (N.J.S.A. 26:3-69.1 et seq.). A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.
The Code established and adopted by this article is described
and commonly known as the "Solid Waste Code of New Jersey (1959)."
Three copies of the said "Solid Waste Code of New Jersey (1959)"
were placed in file in the office of the Secretary of the Board of
Health upon the introduction of this article and will remain on file
there until final action is taken on this article, for the use and
examination of the public.

Receptacles for refuse shall be placed upon curbs or sidewalks
not earlier than 8:00 p.m. of the evening prior to the days designated
for the pickup of refuse, except receptacles for refuse which do not
contain garbage, as said term is defined by applicable ordinance,
statute or other regulation, which have been placed upon the curb
for removal by the Department of Public Works in accordance with the
schedule of that Department. Receptacles shall be removed from curbs
or sidewalks by 9:00 a.m. on the day the refuse has been collected.
As used herein and hereinafter, plastic bags, paper bags or cardboard
boxes shall not constitute a receptacle, and all receptacles must
have a securely fitted lid.
A.
In all residential and/or business buildings having fewer than three tenants, it shall be the responsibility of the landlord to furnish sufficient and suitable receptacles reasonably required for the storage of refuse. It shall also be the responsibility of said landlord to remove said receptacles in accordance with § 529-5 of this article.
