No person shall uncover, make any connection with or opening into or use, alter, disturb or discharge into any public sewer or appurtenance thereof without first obtaining a written permit therefor.
A. 
There shall be two classes of permits:
(1) 
For residential and commercial service users of the city's sewerage system.
(2) 
For industrial users of the city's sewerage facilities.
B. 
The owner or his agent shall apply for a permit on a special form provided by the Board. The permit application shall be supplemented by any plans, specifications or other information requested by the Superintendent or the Board.
C. 
A permit and inspection fee, in an amount set forth in the Fee Schedule adopted by the Board, shall be paid to the City at the time the application is filed.
A. 
Industrial permits. Industrial wastewater discharge permits shall be granted or denied in accord with the terms and procedures set forth in § 177-63 of this Part 2.
B. 
Residential and commercial permits. The Superintendent shall determine whether a residential or commercial permit should be issued, based on his analysis of the plans, specifications and other information submitted in light of the provisions of this Part 2, and shall inform the Board of his conclusion. If the Board so specifies, the Superintendent shall, prior to granting or denying a domestic or commercial permit, submit the matter to the Board for determination. In such a case, the decision of a majority of the Board shall be required to overturn the conclusion of the Superintendent.
A. 
All costs and expense incident to the installation and connection of the building sewer shall be borne by the owner.
B. 
The owner shall indemnify the City and Board from loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
A separate and independent building sewer shall be provided for every building, except that, where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, court, yard or driveway, the building sewer from the front building may be extended to the rear building and the whole considered as one building sewer.
Old building sewers may be used in connection with new buildings only when they are found, on examination and test by the Superintendent, to meet all requirements of this Part 2.
The building sewer shall be cast-iron soil pipe, ASTM Specification A74-42 or equal; vitrified clay sewer pipe, ASTM Specification C13-44T or equal; or other suitable material approved by the Superintendent. Joints shall be tight and waterproof. Any part of the building sewer that is located within 10 feet of a water-service pipe shall be constructed of cast-iron soil pipe with leaded joints or other suitable material approved by the Superintendent. Cast-iron pipe with leaded joints may be required by the Superintendent where the building sewer is exposed to damage by tree roots. If installed in filled or unstable ground, the building sewer shall be of cast-iron soil pipe, except that nonmetallic material may be accepted if laid on a suitable concrete bed or cradle, as approved by the Superintendent.

The size and slope of the building sewer shall be subject to the approval of the Superintendent, but in no event shall the diameter be less than four inches. The slope of such four-inch pipe shall be not less than 1/8 inch per foot.
A. 
Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within five feet of any bearing wall which might thereby be weakened. The depth shall be sufficient to afford protection from frost.
B. 
The building sewer shall be laid at uniform grade and in straight alignment insofar as possible. Changes in direction shall be made only with properly curved pipe fittings.
A. 
Old building sewers. The lines outside the building leading to the curb connections or public sewer may be used by property owners only if they are watertight, gastight and meet all other specifications of this Part 2 and, if not meeting said specifications in their entirety, may be used only with special written approval of the Superintendent.
B. 
All excavations required for the installation of a building sewer shall be open trench work unless otherwise approved by the Superintendent. Pipe laying and backfilling shall be performed in accordance with the pipe manufacturer's recommendation but, in any event, shall conform to the following standards:
(1) 
The ditch shall be straight and true and to uniform grade insofar as possible.
(2) 
The bottom of the trench shall be shaped by hand to receive the pipe, or a minimum of three inches of compacted sand shall be placed in the trench bottom to receive the pipe.
(3) 
Where rock is encountered in the excavation of the trench, the rock shall be excavated at least four inches below the grade of the pipe and covered with compacted sand to provide a sand bed for the pipe.
(4) 
After placing the pipe and making joints as per requirements, earth backfill shall be placed to the height of the top of the pipe and tamped.
(5) 
One foot of earth fill, free from rocks, will then be placed and tamped.
(6) 
The remainder of the trench shall then be backfilled, but all such trenches in City roads shall be filled in one-foot layers and tamped before additional dirt is added.

C. 
Alternate materials and methods may be used only if they have been specifically approved by the Superintendent. He may approve any alternative, provided that the proposed design is satisfactory and complies with terms of this Part 2 and that the material or method of work offered is for the purpose intended and at least the equivalent of that herein prescribed in quality, strength, effectiveness, durability and safety.
D. 
Repairs to sewerage connections shall be made with such materials as is provided for by this Part 2 for new work, insofar as is practical.
E. 
The size, slope, alignment, materials or construction of a building sewer and appurtenances and the methods to be used in excavating, placing of the building sewer pipe, jointing, testing and backfilling the trench shall conform to the requirements of the specifications for the installation of building sewers as adopted by the Board and all applicable provisions of any other rules and regulations of the City or of the County of Warren or the State of New York, whichever requirement is more strict. In the absence of any requirements or in amplification thereof, the materials and procedures set forth in appropriate specifications of the American Society for Testing and Materials (ASTM) and Water Pollution Control Federation (WPCF) Manual of Practice No. 9 shall apply. All connections of building sewers to a public sewerage system shall be gastight and watertight. Any deviations from the prescribed materials and construction procedures must be approved by the Superintendent prior to installation.
A. 
Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor.
B. 
In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sewage carried by such building drain shall be lifted by a method approved by the Superintendent and discharged to a gravity-flow building sewer.
All excavations required for the installation of a building sewer shall be open trench work unless otherwise approved by the Superintendent. Pipe laying and backfill shall be performed in accordance with ASTM Specification C12-19, except that no backfill shall be placed until the work has been inspected.
The applicant for the connection of any building sewer to the city's sewerage system shall notify the Superintendent when the building sewer is ready for inspection and connection to the public sewer. In no case shall any underground portions of the building sewer be covered or connection to the public sewer made without the approval and/or supervision of the Superintendent or his representative. Permission to activate the building sewer will be given only after satisfactory final inspection has been made and approval given by the Superintendent, and connection shall be made under the supervision of the Superintendent or his representative.
A. 
Trench water will not be allowed to enter the public sewer unless specifically authorized by the Superintendent.
B. 
The building sewer trench shall be completely dewatered before the tap is made into the public sewer system.
A. 
All joints and connections shall be made gastight and watertight.
B. 
Cast-iron pipe joints shall be firmly packed with oakum or hemp and filled with molten lead, Federal Specification QQ-L-156, not less than one-inch deep. Lead shall be run in one pouring and caulked tight. No paint, varnish or other coatings shall be permitted on the jointing material until after the joint has been tested and approved.
C. 
All joints in vitrified clay pipe or between such pipe and metals shall be made with approved hot-poured material or cement mortar, as specified below.
D. 
Material for hot-poured joints shall not soften sufficiently to destroy the effectiveness of the joint when subjected to a temperature of 160° F. nor be soluable in any of the wastes carried by the drainage system. The joint shall first be caulked tight with jute, hemp or similar approved material.
E. 
Cement joints shall be made by packing a closely twisted jute or oakum gasket of suitable size to fill partly the annular space between the pipes. The remaining space shall be filled and firmly connected with mortar composed of one part portland cement and three parts mortar sand. The material shall be mixed dry; only sufficient water shall be added to make the mixture workable. Mortar which has begun to set shall not be used or retamped. Lime putty and hydrated lime may be substituted to the extent of not more than 25% of the volume of the portland cement that may be added.
F. 
Other jointing materials and methods may be used only by approval of the Superintendent.
A. 
"Building sewer" shall refer to the connection from the building to the sewer main and shall be the property of the building owner. However, the City shall make the connection from the main sewer to a point inside the curb (between the curb and walk). This will include all excavation, laying sewer lateral, backfilling, replacing pavement, etc.
B. 
A fee will be charged for residential, commercial and industrial users in accordance with a Fee Schedule set by the Board.

C. 
This fee shall be paid by the owner to the City Treasurer, who shall credit it to the appropriate account of the Board of Water and Sewer Commissioners. The Water and Sewer Department shall construct the connection to a building sewer only after the City Treasurer has presented said Department with proof of payment of such fee.
All excavations for building sewers shall comply with all federal, state and local safety regulations and shall be adequately guarded with barricades and lights so as to protect the public from hazard.
Streets, sidewalks and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the city.
A. 
Building sewers shall be maintained, serviced and repaired by the owner of the property served thereby from the building drain to a point within one foot of the street curb (between the curb and walk), if connected to a public sewer in a public right-of-way, and to within two feet of the public sewer located in an easement across private property.
B. 
In the event that a property is unable to discharge sewage into the public sewer, it will be presumed that the fault is in the private building sewer unless contrary facts are in evidence.
C. 
Evidence of willful damage to a building sewer being served by a public sewer shall be considered a violation of this Part 2.
Before any building whose building sewer is connected to a public sewer is demolished, the owner thereof shall conform to the requirements established by the Superintendent. The cutoff or plugging of the building sewer shall be done with the permission and under the supervision of the Superintendent.
