The office of Assistant Township Manager of the Township of Kingston is hereby created.

The Township Manager shall appoint an Assistant Township Manager for an indefinite term to serve at the will of the Township Manager in consideration of compensation to be fixed, from time to time, by the Board of Supervisors.

The Township Manager may remove the Assistant Township Manager in accordance with the procedures more particularly set forth in Article V, Section 502, of the Charter.

The Assistant Township Manager shall be the assistant chief administrative officer of the Township. He/She shall be responsible primarily to the Township Manager and secondarily to the Board of Supervisors for assistance and support to the Township Manager in the administration of all Township affairs placed in his/her charge by the Township Manager; more specifically, in providing assistance and support to the Township Manager in the performance of those powers and duties vested in the Township Manager by Article V, Section 504, of the Charter and by the Administrative Code, except when to so act would be a violation of the provisions of the Charter. The Assistant Township Manager is and will be subordinate, at all times, to the Township Manager in the administration of the business and affairs of the Township of Kingston.

The general description of the functions to be performed by the Assistant Township Manager, together with stated essential job requirements and marginal job descriptions and qualifications of appointment to the position, are attached hereto and made a part hereof.[1] Such document shall be incorporated into the Kingston Township Department of Administrations, and it shall become, upon the enactment of this Part, officially designated and cited thereafter as "Administrative Code, Part 3, Township Organization, Section 301."

If it should become necessary for the Board of Supervisors to designate an Acting Township Manager, pursuant to Article V, Section 503, the Assistant Township Manager shall not be disqualified from acting in such temporary office by reason of his/her service as Assistant Township Manager.

Wherever it may appear in any section, provision, or term of the Administrative Code, or any amendment thereof, that the act or the discretion of the Township Manager shall be implemented, performed or exercised, such section, provision or term of the Administrative Code shall be uniformly and absolutely interpreted to include the act or the discretion of the Assistant Township Manager, unless to so act would constitute a violation of any term or provision of the Charter or of the Code or of the terms and provisions of this Part or be specifically contrary to the stated direction and desire of the Township Manager.
