1. 
North Strabane Township has elected to administer and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. §§ 7210.101-7210.1103, as amended from time to time, and its regulations.
2. 
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401-405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code of this North Strabane Township.

1. 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures:
A. 
Administration and enforcement of the code within this municipality shall be undertaken as prescribed in Chapter 5, Part 1, Code Enforcement.
B. 
The municipality may enter into agreement with other municipalities and act as the administrator of the code.

A Board of Appeals is established by resolution of the governing body of this municipality in conformity with the requirements of the relevant provisions of the code, as amended from time to time, and for the purposes set forth therein. If, at any time, enforcement and administration is undertaken jointly or by intermunicipal agreement with one or more other municipalities, said Board of Appeals may be established by joint action of the participating municipalities or by the individual municipality.

All building code ordinances or portions of ordinances which were adopted by this municipality on or before July 1, 1999, having been approved and listed by the Department of Labor and Industry, shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Code, as amended from time to time, as follows:
A. 
North Strabane Township Code: Chapter 7, Part 5, Subpart A, Suppression Systems, § 502, Findings and Purpose, is incorporated and states:
"The Board of Supervisors finds that there is a greater likelihood of serious bodily injury, loss of life and loss of property in multiple-family residential buildings having two or more dwelling units which are not equipped with residential water sprinkler fire-suppression systems. The Board of Supervisors further finds that it is in the best interests and general welfare of the citizens of the Township to require all newly constructed multiple-family residential buildings having two or more dwelling units which are located within the Township to be equipped with a residential water sprinkler fire-suppression system. . ."
B. 
Uniform Construction Code § 403.1, Scope, (b), Exclusions, (3), is amended to read "[S]tructures having a building area of less than 500 square feet."
C. 
North Strabane Township Code: Chapter 5, Part 2, Uniform Construction Code, § 204(3),[1] is incorporated and states:
"On each additional story of the dwelling, including basements but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels and without an intervening door between the adjacent levels, a smoke alarm installed on the upper level shall suffice for the adjacent lower level, provided that the lower level is less than one full story below the upper level."

All building code ordinances or portions of ordinances which are in effect as of the effective date of this Part and whose requirements are less than the minimum requirements of the code are hereby amended to conform with the comparable provisions of the code.
3. 
All relevant ordinances, regulations and policies of this municipality not governed by the code shall remain in full force and effect.

Fees assessable by the municipality for the administration and enforcement undertaken pursuant to this Part and the code shall be established by the governing body by resolution from time to time.

This Part shall be effective five days after the date of passage of this Part.

If any section, subsection, sentence, or clause of this Part is held, for any reason, to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Part.
