JUNK
Any discarded material or articles such as is not ordinarily disposed of as rubbish or refuse. A junk or salvage yard shall be construed to mean the storing, accumulating, selling or processing of junked vehicles, whether or not such storing, accumulating, selling or processing is done for profit. Two or more junked or abandoned vehicles shall be construed as coming within the scope and meaning of this Part 1. Moreover, any recycling or impacting or removal, shipment or reuse shall be deemed to come within the scope and meaning of this Part.
JUNK DEALER
Any person, as hereinafter defined, who shall engage in the business of storing, accumulating, selling or processing of junked vehicles.
PERSON
Any natural person, partnership, firm or corporation.

From the passage of this Part, no junk or salvage yard shall be established or maintained except in an industrial zone as a special exception.

No person in the Township of North Strabane shall engage in business as a junk or salvage dealer, whether under this Part or as a preexisting nonconforming use, without first having filed an application with the Township Office in December of each year. Such application shall provide information as to the names and addresses of the owner(s) of the tract of land to be utilized, or the names and addresses of the lessees, information to the use and extent of the junk or salvage yard, and shall be accompanied by a permit fee for the ensuing year in the amount of $200.
Provided that all applicable state and Township laws and ordinances have been complied with, the Zoning Officer shall issue a permit for the operation and maintenance of the junk or salvage yard for one year. Such permit fee shall be renewed annually on or before the first day of January of each year.

1. 
All junk or salvage yards whether or not established prior to the date of this Part, shall comply with the following rules and regulations:
A. 
No person under this Part shall by virtue of one permit keep more than one place of business within the Township of North Strabane for the purpose of establishing and maintaining a junk or salvage yard. Nor shall any such person engage in the junk or salvage business in any place other than the place designated upon the permit.
B. 
No permit issued under this Part shall be transferred from one person to another, except when the ownership of the premises shall change. In such a case a new owner shall apply for a transfer of such permit to him and shall pay a transfer fee of $50.
C. 
Every junk or salvage yard dealer shall provide and constantly keep a book in which shall be fairly written down in the English language, at the time of the purchase or sale of any junk, a description of any article or material purchased, sold or received by him, the date and hour of such transaction, and the person or persons from whom such items were purchased, sold, or received concerning said transaction. Such book shall at all times be subject to inspection by the Township Zoning Officer and the Police of said Township.
D. 
No junked or abandoned vehicle shall be dismantled, altered from its original form, or destroyed except after a period of 48 hours from the purchase, receipt or delivery thereof to such junk or salvage yard.
E. 
Each such establishment shall have on duty an employee during normal working hours when the establishment is in operation.
F. 
No junk or salvage yard shall be established or maintained within an area of 50 feet to any street or road or to any property line.
G. 
Each such establishment shall be protected with steel posts and cyclonefence at least eight feet in height from the ground with structural type qualities and evergreens of the tree variety shall be planted and grown a maximum of 10 feet apart on the outside of the fence upon the property of the owner.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
