The short title of this article shall be the "Penndel Borough Recycling Ordinance," and the same may be cited in that manner.
When used in this article, the following words should have the following meanings:
ALUMINUM CANS
Empty all-aluminum beverage and food containers.
BIMETALLIC CONTAINERS
Empty food or beverage containers consisting of steel and aluminum.
BOROUGH
The Borough of Penndel, County of Bucks, Commonwealth of Pennsylvania.
CORRUGATED PAPER
Structural paper material with an inner core shaped in rigid parallel furrows and ridges.
FERROUS CONTAINERS
Empty steel or tin-coated-steel food or beverage containers.
GLASS CONTAINERS
Bottles and jars made of clear, green or brown glass. Excluded are plate glass, automotive glass, blue glass and porcelain and ceramic products.
LEAF WASTE
All leaves from trees, bushes and other plants, garden residue, chipped shrubbery and tree trimmings but not including grass clippings.
MAGAZINES AND PERIODICALS
Printed matter containing miscellaneous written pieces published at fixed or varying intervals. Expressly excluded are all other paper products of any nature whatsoever.
NEWSPAPERS
Paper of the type commonly referred to as newsprint and distributed at fixed intervals, having printed thereon news and opinions, containing advertisements and other matters of public interest. Expressly excluded are glossy advertising inserts often included with newspapers.
PLASTIC CONTAINERS
Empty plastic food and beverage containers. Due to the large variety of types of plastics, the recycling regulations may stipulate specific types of plastic that may be recycled.
RECYCLABLE MATERIALS
Those materials identified by the municipality to be recycled.
RESIDENTIAL DWELLINGS
Any occupied single-family or multifamily dwelling having up to four dwellings per unit per structure for which the municipality provides municipal waste collection service.
RESIDENTS
Owners, lessees and/or occupants of residences located in the Borough of Penndel.
SOLID WASTE
Material whose original purpose has been completed and which is directed to a disposal or processing facility or is otherwise disposed. The term does not include recyclable materials or materials approved by the Department of Environmental Protection for beneficial use.
A mandatory municipal recycling program is hereby established for all residential dwellings within the Borough. All residents of the Borough of Penndel shall separate recyclable materials and leaf waste from solid waste and dispose of said recyclable materials as set forth herein.
Recyclable materials shall be placed at the curb in designated containers and shall be separate from solid waste.
Leaf waste shall be separated from solid waste and other recyclable materials. Leaf waste shall be placed at the curb in designated containers at times designated by the Borough.
A. 
Residents shall not dispose of recyclable materials or leaf waste with ordinary municipal waste.
B. 
Residents or any other persons shall not collect or pick up or cause to be collected or picked up any recyclable material unless authorized by the Borough. Such acts shall be deemed to be violations of the article. Each such collection shall constitute a separate and distinct offense and violation punishable as herein provided.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be subject to a fine of not more than $1,000 or imprisonment for a term not to exceed 30 days, or both, at the discretion of the court. Each day that a violation continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.
