The purpose of this article is to calculate and set sewer system
tapping fees in accordance with Act 57 of 2003, 53 Pa.C.S.A. § 5607(d),
(P.L 404) ("Act 57"), based upon a Sewer System Capital Charges Study
pursuant to Act 57 of 2003, prepared by Glace Associates, Inc., dated
November 2009 ("Study"). The study is marked and attached hereto as
Attachment A and incorporated herein by reference as if set forth
in its entirety and made a part of this article.[1]

A.
Section 47463 of the Borough Code, 53 P.S. § 47463, authorizes
the Borough of Penndel to charge a tapping fee whenever the owner
of any property connects his property with a sewer main constructed
or acquired by the Borough.
B.
Section 10507-A(a) of the Pennsylvania Municipalities Planning Code
("MPC"), 53 P.S. § 10507-A(a), requires that tapping fees
be calculated in accordance with the applicable provisions of the
Municipality Authorities Act, 53 Pa.C.S.A. § 5601 et seq.
(the "Act").
C.
Act 57 amended the Act as to the method of calculating and determining
tapping fees.
This article shall apply to the entire sewer system owned and
operated by the Borough.
As used in this article, the following terms shall have the
meanings indicated:
Any room, group of rooms, house, trailer or other structure
or enclosure occupied or intended for occupancy as separate living
quarters by a family or by persons living together or by persons living
alone. For a nonresidential use, the sewer flows for such use, divided
by 216 gallons per day, shall be the number of EDUs for such nonresidential
use.
The fee authorized by Act 203 of 1990, as amended by Act
57, and which is required to be paid upon application to connect any
improved property to the sewer system operated by the Borough.
A.
Any property owner desiring to connect to the Borough's sewer
system shall pay the Borough prior to connecting thereto a tapping
fee of $4,997.41, plus a reimbursement component known as an "improvement"
fee assessed by the Bucks County Water and Sewer Authority.

All other ordinances, resolutions, rules and regulations of
the Borough relating to the provision of sewer service to the extent
not specifically amended or modified hereby shall remain in full force
and effect, it being the specific intent of this article to establish
sewer system tapping fees in accordance with the Act, as amended by
Act 57.
