No person, corporation, partnership or association shall henceforth
offer any item of real estate or personal property for sale in the
Township of Upper Moreland by public sale or auction, nor shall any
person, corporation, partnership or association suffer or permit such
sales to take place on property owned or possessed by it, without
first obtaining an auction permit from the Township.
Every applicant for an auction or public sale permit shall provide
and every permit shall set forth the date or dates and location when
such auction or public sale shall take place, the approximate hours
during which the auction or public sale shall be in process. If there
is to be a display for public examination, the application shall state
the date, time and location of the examination period. Said application
shall further set forth the name and address of the person or persons
conducting the sale.
No auction or public sale permit shall be issued to any applicant
conducting an auction house or public sale room at a permanent location
at regular intervals unless the applicant can provide adequate off-street
parking to accommodate one vehicle for every three persons reasonably
expected to be in attendance.
The auction or public sale permit shall at all times be prominently
displayed during any period of public examination of the real or personal
property to be sold and during the time when the public sale or auction
is being conducted.
The fee for the issuance of each auction or public sale permit
shall be as set from time to time by resolution of the Board of Commissioners.
No permit shall be issued less than 24 hours prior to the time of
the sale or auction commencing without approval of the Township Manager
or Police Chief. Nonprofit organizations shall be exempt from the
payment of such fees but shall comply with all other requirements.
Any person violating the provisions of this chapter shall, upon
summary conviction before a magisterial district judge, be sentenced
to pay a fine of not less than $50 nor more than $600 and costs of
prosecution and, in default thereof, shall undergo imprisonment for
not more than 30 days.
This chapter shall not apply to Sheriff's or other court-ordered
sales.
