This article shall apply to the maintenance of buildings of R-1 and R-2 Use Groups with common areas open to public use including, without limitation, hallways, lobbies, basements, storage areas, etc.
This article shall not apply to occupancies where each living unit exits directly to grade and/or there are no common areas open to public use.
It shall be unlawful to maintain a building of R-1 or R-2 use with common areas open to public use without first having obtained a permit from the Fire Marshal. Issuance and maintenance of a permit shall be in accordance with applicable sections of this article.
Buildings and structure and their safety equipment shall be maintained in a safe condition as required by this article and any other applicable codes that may apply.
Any owner of property found to be in violation of the provisions of § 153-14 shall, upon summary conviction in district court, be ordered to pay a fine of not less than $50 nor more than $300 for each violation, plus costs of prosecution, and in default thereof shall undergo imprisonment for not more than 30 days. Each day of violation shall constitute a separate offense.
