As used in this article, the following terms shall have the
meanings indicated:
A person, firm or corporation who or which shall receive
gasoline or flammable liquids, whether by retail sale or any other
method, from any retail filling station or service station.
Any place in the Township of Upper Moreland where pumps or
other dispensing devices are available for the dispensing of gasoline
or other flammable liquids for sale to the public.
A.
It shall be unlawful for any owner, lessee, operator or employee
of any retail filling station or service station located in the Township
of Upper Moreland, Pennsylvania, to permit any purchaser, customer
or other person to use or manipulate any pump, hose, pipe or other
device for pumping or dispensing gasoline or other flammable liquid
for any purpose, unless such dispensing of gasoline or other flammable
liquid shall be conducted under the supervision of a person trained
in the dispensing of such gasoline or flammable liquids and under
such conditions that the person supervising shall be within 25 feet
of the point of dispensing of such gasoline or flammable liquids at
all times during the dispensing. The only exception to the twenty-five-foot
limit is where there is located at a retail filling station on one
or more pump islands a control panel therein controlling all of the
gasoline pumps on the pump island or islands, where said attendant
is in full and unobstructed view of all customers and gasoline pumps.
Said booth shall be constructed in such a manner as to provide a full
view of all gasoline pumps at said retail filling station.
B.
It shall be unlawful for any purchaser or customer of a gasoline filling or service station in the Township of Upper Moreland to use or manipulate any pump, hose, pipe or other device for the pumping or dispensing of gasoline or other flammable liquid for any purpose unless such dispensing shall be conducted under the supervision of a person trained in the dispensing of such gasoline or flammable liquids and under such conditions that the person supervising shall be within 25 feet of the point of dispensing of such gasoline or flammable liquids at all times during the dispensing or at a control booth located as specified in Subsection A above.
C.
Every retail filling station or service station providing self-service
accommodations located in the Township of Upper Moreland shall at
all times have posted at conspicuous locations on each pump island
at least one sign of minimum size of 12 inches by 15 inches with lettering
no less than a uniform size of 1/2 inch, containing the following
statement:
IT IS UNLAWFUL UNDER THE TOWNSHIP CODE OF UPPER MORELAND TOWNSHIP
FOR CUSTOMERS TO HANDLE PUMPS OR HOSES FOR DISPENSING FLAMMABLE LIQUIDS
UNLESS A STATION ATTENDANT IS WITHIN 25 FEET OF POINT OF DISPENSING
OR OBSERVING IN FULL VIEW FROM AN ISLAND BOOTH.

E.
Containers.
(1)
Class I, II and IIIA liquids shall be dispensed into containers of
approved material and construction, have tight closure with screwed
or spring-loaded cover so designed that the contents can be dispensed
without spilling. Liquids shall not be dispensed into portable tanks
or cargo tanks.
(2)
A hose nozzle valve used for dispensing Class I liquids into portable
containers shall be in compliance with the latest edition of the International
Fire Code and be manually held open during the dispensing operation.
(3)
Portable containers shall not be filled while located in the trunk,
passenger compartment or truck bed of a vehicle.
Any person, firm, partnership or corporation who or which shall
violate the provisions of this article shall, upon conviction thereof,
be sentenced to pay a fine of not less than $25 nor more than $300,
together with the costs of prosecution, or in default of payment thereof
by imprisonment for not more than 30 days.
