The provisions of this article are designed to secure, promote
and protect the public health, safety, morals, and general welfare
of the residents of Upper Moreland Township and to reduce the dangers
of fire within the school buildings and facilities of the Township.
The following terms, when used in this article, shall have these
stated meanings:
A learning institution or facility within the Township, including
vocational-technical schools and intermediate units.
Possession of a cigarette, pipe, cigar or similar object
which is ignited or lit and emits smoke.
Includes smoking and the use of any smokeless tobacco.
A.
Except as hereinafter provided in § 274-4 of this article, smoking or tobacco use shall be prohibited in the Township Building, all school buildings, school buses, school facilities and vocational-technical facilities within the Township of Upper Moreland.
B.
Removal of signs prohibited. It shall be unlawful for any person
to remove, obscure, deface, mutilate or destroy any posted "No Smoking"
or "Smoking Area" signs.
A.
The school authorities may designate specific safe areas where smoking
shall be permitted in each school building or facility, which shall
be posted "Smoking Area" and shall be subject to the approval of the
Fire Marshal.
B.
Ash trays. Where smoking is permitted, noncombustible ash trays or
match receptacles shall be provided at convenient locations within
the designated area.
A.
"No Smoking" signs. The Fire Marshal, or other designated official,
is hereby authorized to order and direct the posting of "No Smoking"
signs in the entrance of the Township Building and each school building
or facility and in all school buses. The content, lettering, size,
color and location of the required "No Smoking" signs shall be subject
to the approval of the Fire Marshal.
B.
"Smoking Area" signs. The Fire Marshal, or other designated official,
is hereby authorized to order and direct the posting of "Smoking Area"
signs in those areas where employees shall be permitted to smoke.
The primary responsibility for the enforcement of this article
shall be with a designated official. The Fire Marshal shall have secondary
enforcement responsibilities of this article.
Any person who shall violate any of the provisions of this article
shall, upon conviction, be sentenced to pay a fine of not less than
$50 nor more than $600 and costs of prosecution for each violation
or, in default of payment of such fine and costs, to undergo imprisonment
for not more than 90 days for each violation.
