A.
The Board of Commissioners may from time to time amend, supplement,
change or modify this chapter and the Zoning Map in accordance with
the following procedures.
B.
Before voting on the enactment of an amendment, the Board of Commissioners
shall hold a public hearing thereon, pursuant to public notice, published
once a week for two successive weeks in a newspaper of general circulation,
with the first publication being not more than 30 days prior to the
date of the proposed hearing and the second publication not less than
seven days prior to the date of the proposed hearing. In addition,
if the proposed amendment involves a Zoning Map change, notice of
said public hearing shall be conspicuously posted by the Zoning Officer
at such points along the perimeter of the tract sufficient to notify
potentially interested persons of the proposed change. The affected
tract or area shall be posted at least one week prior to the date
of the hearing.
C.
In the case of an amendment other than that prepared by the Planning
Agency, the Board of Commissioners shall submit such amendment to
the Planning Agency at least 30 days prior to the hearing on such
proposed amendment to provide the Planning Agency an opportunity to
submit recommendations.
D.
If, after any public hearing held upon an amendment, the proposed
amendment is changed substantially or is revised to include land previously
not affected by it, the Board of Commissioners shall hold another
public hearing, pursuant to the public notice, before proceeding to
vote on the amendment.
E.
At least 30 days prior to the public hearing on the amendment by
the Board of Commissioners, the proposed amendment shall be submitted
to the Montgomery County Planning Commission for its recommendations.
G.
Within 30 days after enactment, a copy of the amendment to the Zoning
Ordinance shall be forwarded to the Montgomery County Planning Commission.
Whenever the owners of 50% or more of the frontage in any district shall present to the Board of Commissioners a petition duly signed and acknowledged requesting an amendment, supplement, change, modification or repeal of the regulations prescribed for or of the Zoning Map including such district, it shall be the duty of the Board of Township Commissioners to hold a public hearing thereon and cause notice thereof to be given in the manner prescribed in § 350-255.
All ordinances or parts of ordinances which are inconsistent
