For the purpose of this chapter, the following words and phrases shall have the following meanings:
PERSON
Any institution, public or private corporation, individual, partnership, or other entity.
REFUSE
All solid wastes of a community, including garbage, ashes, rubbish, small dead animals, street cleanings, brush, grass clippings, trees, building materials, and solid market and industrial wastes.
SANITARY LANDFILL AREA
Any area of land owned, rented, or leased by the Town, now or in the future, which is specifically set aside for the disposal of refuse.
TOWN
The Town of Haddam, a municipal corporation located in Middlesex County, in the State of Connecticut.
A. 
The sanitary landfill area shall be open for refuse disposal from 9:00 a.m. to 5:00 p.m., Mondays, Tuesdays, Wednesdays, Fridays and Saturdays.
B. 
The sanitary landfill area shall be closed for the disposal of refuse on Thursdays and Sundays, and on legal holidays and on such other day or days that the Board of Selectmen may designate.
C. 
Notwithstanding the foregoing and the provisions of Subsection A hereof, the Board of Selectmen may permit the sanitary landfill unit to be used on a day and time when it would normally be closed when, in the judgment of the Board of Selectmen, the health and welfare of the Town so requires.
A person who neither resides nor has a place of business in the Town may dispose of refuse in the sanitary landfill area, provided that said refuse is a direct result of work, operations, or business undertaken by him, whether by contract or otherwise, in the Town, and that such person obtains a permit from the Board of Selectmen, each such permit requiring payment of a fee of $5 and expiring after 10 days. Notwithstanding the foregoing, nonresident refuse collectors shall be governed by the provision of § 125-5 hereof.
The sanitary landfill area shall be open for the disposal of refuse to any person residing or having a place of business in the Town, subject to the provisions of §§ 125-6, 125-7 and 125-8 hereof. Notwithstanding the foregoing, resident refuse collectors shall be governed by the provisions of § 125-5 hereof.
Any person, whether or not he resides or has a place of business in the Town, may dispose of refuse in the sanitary landfill area, provided he is licensed by the Town as a refuse collector.
No person, whether or not he resides or has a place of business in the Town, may dispose of refuse in the sanitary landfill area when such refuse is the direct result of work, operations, or business undertaken by him, whether by contract or otherwise, in a location or area outside the Town.
No person may dispose of junk cars, vehicles or parts thereof at the sanitary landfill area.
The Board of Selectmen may prohibit the disposal of any refuse by any person in the sanitary landfill area when such refuse is of such a nature and quantity as to be, in their opinion, dangerous to the public health, welfare or safety, or prejudicial to the operation of the sanitary landfill area. Notwithstanding any other provisions of this chapter, the Board of Selectmen may enter into contracts with any person for the disposal of refuse of a special nature or quantity at a charge to be determined by such contract.
Any person disposing of refuse in the sanitary landfill area shall dispose of such refuse by dumping or otherwise in specific locations as determined by and under the supervision of the Board of Selectmen or their agent, and shall be required to separate his or her refuse in such manner as required by the Board of Selectmen.
Scavenging at the sanitary landfill area without express written authorization by the Board of Selectmen shall be prohibited.
No person shall enter or be permitted within the sanitary landfill area except during the hours when the area is open to the public and the custodian is on duty. Every motor vehicle entering the landfill area shall display such identification insignia as may be issued by the Board of Selectmen.
Any vehicle carrying refuse to the sanitary landfill area shall carry such refuse, either by covering it or in some other suitable manner, so that such refuse shall not blow or fall off the vehicle and create an unsightly roadside condition.
The Board of Selectmen may make agreements with the Town of East Hampton for use of its sanitary landfill area by the residents of the Haddam Neck area of the Town of Haddam upon payment of an annual charge to be determined by agreement between the Board of Selectmen of the Town and the Board of Selectmen of the Town of East Hampton, such agreement to be revised at least annually.
Violations of any section of this chapter shall be punishable by a fine of not more than $100 for each offense, and each day that the violation shall exist or continue shall be deemed a separate offense.
