The New Jersey Legislature recently revised various statutes concerning the sale of tax liens and other municipal liens. The law took effect on January 18, 2010. Various sections of N.J.S.A. 54:5-19 et seq. were revised to authorize Tax Collectors involved in lien collection and enforcement to charge various fees if authorized by the governing body of the municipality. Pursuant to these amendments the municipality is hereby authorizing the Tax Collector to charge the following fees in connection with lien collection and enforcement.

In lieu of any two publications, notice to the property owner and to any person or entity entitled to notice of the foreclosure pursuant to N.J.S.A. 54:5-104.48 may be given by regular or certified mail, the cost of which shall be added to the cost of the sale in addition to those provided in N.J.S.A. 54:5-38. The Tax Collector is hereby authorized to charge a fee of $25 for each notice mailed for a particular property.
The Tax Collector shall provide to any party entitled to redeem a certificate pursuant to N.J.S.A. 54:5-54 two calculations of the amount required for redemption within a calendar year at no cost. Any subsequent calculation requested of the Tax Collector shall require a fee of $50 for each request. A request for a redemption calculation shall be made in writing to the Tax Collector.
The Tax Collector is hereby authorized to charge a lienholder a fee of $50 for the calculation of the amount due to redeem the tax lien required to be provided pursuant to N.J.S.A. 54:5-97.1. Any request for a redemption calculation shall specify the date to be used for the calculation, which shall be the date of the notice. Neither the Tax Collector nor the municipality shall be liable for an incorrect calculation. The fee paid to the municipality shall not become part of the lien and shall not be passed on to any party entitled to redeem pursuant to N.J.S.A. 54:5-54.

The Tax Collector is hereby authorized to charge an annual fee of up to $1,500 paid in advance for any electronic file requested. The Mayor and City Clerk are hereby authorized to execute any and all agreements for the annual fee set forth herein. The Tax Collector shall collect such fees and deposit same with the Chief Financial Officer of the municipality. This fee shall not apply to mortgage companies in connection with the direct billing and payment of real estate taxes. The fee charged herein is equivalent to the approximate amount of the administration and related costs associated with the request.
