No street or public thoroughfare or part thereof shall be laid
out or opened to public use within the limits of said City except
by the direction or with the consent of the Common Council first obtained.
Any person or corporation violating any of the provisions of § 273-14 shall forfeit and pay a penalty of $50 for each period of 10 days during which said street or thoroughfare or part thereof shall remain open and accessible to the public, and the original opening aforesaid, and each continuing period of 10 days, as aforesaid, shall constitute a distinct and separate offense.
