A Board of Adjustment is hereby established. Said Board shall consist of seven members to be appointed by the Mayor with the approval of the City Council. Members of the City Planning Commission can be members of this body. The term of office of Board members shall be for staggered terms of two years each.

A. 
The Board of Adjustment shall adopt rules necessary to conduct its affairs and in keeping with the provisions of this chapter. Meetings shall be held at the call of the Chairman, or in his absence, the Acting Chairman, may administer oaths and compel the attendance of witnesses. All meetings shall be open to the public.
B. 
The Board shall keep minutes of its proceedings showing the vote of each member upon each question, or if a member is absent or fails to vote, such fact shall be indicated. The Board shall keep a record of all of its official actions, said record to be filed in the office of the Board as a public record and in the City Clerk's Office.
The Board of Adjustment shall have the following powers and duties:
A. 
Administrative review. To hear and decided appeals where it is alleged there is an error in any order, requirement, decision or determination made by the administrative officials in the enforcement of this chapter, and may reverse, affirm, or modify any administrative action related thereto.
B. 
Variances. To authorize in specified cases such variance from the terms of this chapter as will not be contrary to the public interest. The conduct of hearings on variances shall be conformance with the provisions of Articles VII, VIII and IX of this chapter.
C. 
Use permits: special and conditional. To hear and decide on only such special use permits as the Board is specifically authorized to pass on by the terms of this chapter. Board action on said special use permits shall be in conformance to the provisions of Articles VII, VIII and IX of this chapter.[1]

Any person or persons, or any board, taxpayer, department, or bureau of the City aggrieved by any decision of the Board of Adjustment may file a written notice of appeal to the City Council in the manner specified in Article IX of this chapter. A fee of $50 shall be paid to the City of Las Vegas through the Community Development Department upon the filing of the written appeal to defray the cost of advertising.
