A Village Plan Commission
is hereby created as authorized by §§ 61.35 and 62.23
of the Wisconsin Statutes.
The members of the Plan Commission shall be appointed by the
Village President, who shall also choose the presiding officer. The
Village President may appoint himself or herself to the Commission
and may appoint other Village elected or appointed officials, except
that the Commission shall have at least three citizen members who
are not Village officials. Citizen members shall be persons of recognized
experience and qualifications.
The members of the Plan Commission shall be appointed to hold
office for a period of three years. Appointment shall be made by the
Village President during the month of April, or as soon thereafter
as reasonably practicable, for terms that expire in April or at any
other time if a vacancy occurs during the middle of a term. The Village
Plan Commission shall remain as constituted at the time of adoption
of this article until appointments are made under this provision.
The organization (except for the membership as above provided
for), powers, duties and qualifications of the Village Plan Commission
shall be as set forth in the provisions of §§ 61.35
and 62.23 of the Wisconsin Statutes, which are hereby adopted by reference,
and as may be provided by Fox Point ordinance. Except where otherwise
expressly provided by Wisconsin Statute or Fox Point ordinance, all
decisions and recommendations of the Plan Commission are advisory
only and subject to approval, rejection, or modification by the Village
Board.

In Village Plan Commission actions involving special exceptions
and variances, in addition to any notice requirements under any applicable
state or federal law, or as otherwise provided in the Village of Fox
Point Code, the Village Clerk/Treasurer, or his or her designee, shall
provide notice by first class mailing to the owners or occupants of
all properties within 500 feet of the subject property at least 21
days prior to any hearing or proceeding.
