A.
There shall be a Public Defender who shall be appointed by the Mayor,
with the advice and consent of the Council, for a term of one year,
commencing January 1, and until his or her successor shall be appointed
and qualify.
B.
The Public Defender shall appear before the Municipal Court to defend
the cases of indigent persons which are referred to him or her by
the Judge of the Municipal Court.
C.
No person shall serve as the Public Defender unless the person is
licensed as an attorney at law in good standing and admitted for practice
in the State of New Jersey.
The Public Defender shall receive compensation as fixed annually
by the Borough Council.
The Judge of the Municipal Court shall impose a fee of $200
upon granting an application for the Public Defender. The fee may
be waived by the Court, in whole or in part, if the Court determines,
upon a clear and convincing showing by the applicant, that the application
fee represents an unreasonable burden on the individual requesting
representation. The Judge of the Municipal Court in the Borough shall
make the determination on the ability to pay the fee and the determination
of indigence.
