The purpose of this article shall be to preserve the public peace and good order in the Village and to contribute to the public welfare, safety and good order of its people and to contribute to the safe conveyance of its people over the streets and sidewalks of the Village of Delhi by establishing certain regulations for the removal of snow and ice from the streets and sidewalks of the Village that are consistent with the rights and privileges of other residents of the Village.
It shall be the duty of the owner and/or occupant of every parcel of real estate abutting a public sidewalk, whether the parcel of real estate is occupied by a structure or not, to keep said sidewalk free from snow and ice for the full width and length of such sidewalk.
Snow and ice shall be removed as soon as practicable, but in any event, within 24 hours after the end of a snowfall. At any time when an accumulation of snow and ice shall be frozen so hard that it cannot be removed without damaging the sidewalk, it shall, within the time specified herein, be covered with sand, salt or other suitable material. As soon as practicable thereafter, the sidewalk shall be completely cleared of snow and ice.
Whenever an owner or occupant fails to remove the snow and/or ice from any such abutting sidewalk within the time specified herein, or within 24 hours after notice by the Code Enforcement Officer of the Village of Delhi to remove same, it shall be the duty of the Code Enforcement Officer to issue a violation to the owner or occupant and authorize the removal of said snow and/or ice from such sidewalk and notify the Village Clerk of the removal expense incurred.
The Village Clerk shall thereafter promptly present a bill for the removal of said snow and/or ice to the owner and/or occupant of the real estate abutting such sidewalk. If said bill is not paid within 30 days, the cost thereof shall be assessed against the property, shall be added to the tax bill and shall become a lien on said property, collectible in the same manner as delinquent Village taxes as set forth in Article I of Chapter 262 of the Village's Code.
No person, firm, corporation, property owner or occupant shall remove snow or ice from any parcel of real estate and place it upon another parcel of real estate without the express permission of the owner of the parcel of real estate upon which the snow and ice is to be placed.
No person, firm, corporation, property owner or occupant shall deposit, thrown, place or strew, or cause to be deposited, throw, placed or strewn, any snow or ice upon any street, avenue or roadway within the Village of Delhi.
The Village shall publish a notice in a newspaper circulating in the Village each October to effectuate and advise of the objects and purposes of this article. Such notice shall be presumptive evidence of knowledge of the objects and purposes of this article.
Any person, firm, corporation, property owner or occupant that shall violate any section of this article shall be subject to a fine not exceeding $250. If said fine is not paid within 30 days, the cost thereof shall be assessed against the property, added to the tax bill and shall become a lien on said property, collectible in the same manner as delinquent Village taxes as set forth in Article I of Chapter 262 of the Village's Code.
Should any section, paragraph, sentence, clause or phrase of this article be declared unconstitutional or invalid for any reason, the remainder of said local law shall not be affected thereby.
This article shall become effective immediately upon filing with the Secretary of State.
