Township of Waterford, NJ Article IV Defined Contribution Retirement Program

§ 44-20 Participation required for eligible positions.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:

A. Township Administrator;

B. Township Solicitor that does not meet the status as an independent contractor;

C. Municipal Court Judge;

D. Municipal Prosecutor;

E. Municipal Public Defender;

F. Planning Board Attorney.

§ 44-21 Exemption positions.

Individuals serving in the following positions are exempt from Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:

A. Registered Municipal Clerk;

B. Chief Financial Officer;

C. Treasurer:

D. Principal Public Works Manager;

E. Tax/Utility Collector;

F. Tax Assessor;

G. Court Administrator;

H. Qualified Purchasing Agent;

I. Zoning/Code Enforcement Officer;

J. Licensed Uniform Subcode officials and inspectors.

§ 44-22 Legislative authority.

This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.), as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
