As used in this chapter, the following terms shall have the meanings indicated:
BOARD OF RECREATION
The Board of Recreation of the Borough of Hawthorne.
BOROUGH
The Borough of Hawthorne.
PERSON
Any person, firm, partnership, association or corporation.
PUBLIC LANDS
Includes any and every public street, highway, sidewalk, square, public park or playground or any other public place in the Borough of Hawthorne that is within the jurisdiction and control of the Borough of Hawthorne. For purposes of this chapter, lands owned by the County of Passaic, State of New Jersey and the federal government of the United States shall be deemed public lands.
RECREATION AREA
Includes any and every public park, field, or other recreation area, as well as park areas or parklands, including specifically the following locations:
A. 
The Hawthorne Memorial Pool and grounds.
B. 
Wagaraw Road Baseball/Softball Complex.
C. 
Veterans Field at the Kohler Facility.
D. 
Franklin Field and "Little" Franklin Field.
E. 
The Eight Acre Woods.
F. 
Rhodes Park.
G. 
The roller rink at Hawthorne High School.
ROAD AND PARKING AREA
Includes any road, street, lane, drive aisle, driveway, or like public place as well as any designated parking area within any recreation area or otherwise utilized in conjunction with such recreation area for purposes of vehicular traffic and parking.
VEHICLE
Every motorized device in, upon or by which a person or property is or may be transported upon a road, street or highway.
A. 
Permit required. Wherever required by this chapter or otherwise established by rule or regulation duly adopted and promulgated by the Board of Recreation, no person or entity shall utilize any public recreation area without first obtaining a permit, license or pass.
B. 
Hours. Except as otherwise posted or established, and subject to the issuance of a permit where required, no recreation area shall be utilized for any purpose after dusk or before 6:00 a.m.
C. 
No smoking. In every area where active recreation is taking place, and unless specifically authorized though the creation of a designated smoking area by the Board of Recreation, there shall be no smoking.
D. 
Rules and regulations. Rules and regulations for use of all recreation areas may be established from time to time by the Board of Recreation, and the Board of Recreation shall have the exclusive jurisdiction to make and promulgate rules, regulations and policies consistent with this chapter. The Board of Recreation shall specifically adopt policies setting forth residency and eligibility requirements for permits to be issued by the Board for programs funded by the Borough of Hawthorne, in whole or in part, or programs administered by the Board of Recreation.
E. 
Closing of facilities. The Mayor, Administrator, Director of Public Works, Chief of Police or any duly named designee of any such person may close or suspend use of any park, field or facility hereunder for reasons of public health, safety or welfare.
F. 
Code of conduct. In addition to establishing rules and regulations for use of recreation areas, the Board of Recreation shall promulgate a code of conduct applicable to the use of all athletic fields where permits have been issued for use of such facilities.
Any person or persons violating any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $2,000 or imprisonment for a term not to exceed 90 days or a requirement to perform community service for a period not to exceed 90 days. This is in addition to any specific penalty otherwise provided for in any section of this chapter.
