TENNIS FACILITIES
Definitions. The following words and phrases, when used in this article,
shall have the following meanings:
Natural persons who have attained the age of 18 years.
The Borough of Hawthorne.
The Municipal Council of the Borough.
Bona fide guests of a resident.
Natural persons who have not attained the age of 18 years.
Natural persons who have not yet attained the age of 14 years.
Natural persons who are bona fide domiciled in the Borough.
That portion of the Borough-owned property designated as
”Lot 15 in Block 47" on the current Assessment Map of the Borough
on which municipally operated tennis courts are located.
B.
Word usage. Any word herein importing the masculine gender shall
include and apply to females as well as males. Any word herein importing
the singular number shall include and apply to several persons as
well as one person.
The use of the tennis courts shall be subject to such rules
and regulations as may from time to time be promulgated by the Board
of Recreation consistent with this chapter. Such rules and regulations
may be enforced by members of the Police Department, the Director
of Public Works or his designee or the Board of Recreation or persons
designated by the Board to enforce the same.
The tennis courts shall be open on such days and during such
hours as shall be determined by the Board of Recreation. No person
shall use the tennis except upon such days and within such hours that
said tennis courts are open for the enjoyment thereof in accordance
with the rules and regulations established by the Board of Recreation.
The use of such tennis courts, because of their limited accommodations,
shall be limited to residents of the Borough of Hawthorne and their
guests as hereinafter provided, subject to the payment of the fees
as hereinafter stated.
A.
The use of the tennis courts, except as herein otherwise provided, shall be limited to those residents who purchase season admission tickets or cards from the Borough through the Board of Recreation at the Municipal Building at such times and on such dates as may be established by the Board of Recreation. All persons utilizing the tennis courts shall maintain in his or her possession a season admission ticket, card or pass while utilizing the tennis courts. The fees or charges for said admission tickets or cards are as set forth in Chapter 220, Fees.
B.
No season admission tickets or cards shall be issued to guests, but such guests may be admitted to the tennis courts upon the payment of the daily fees or charges as set forth in Chapter 220, Fees.
C.
No minor shall be permitted use of the tennis courts after 5:00 p.m.
unless he or she is accompanied by an adult holding a season admission
ticket.
The governing body, the Mayor, the Director of the Department
of Public Works, the Board of Recreation, or any police officer may
close the tennis courts whenever, in their judgment, such action is
deemed necessary or desirable for the protection of the health or
welfare of such residents or guests entitled to use the tennis courts
or for the protection of the health or welfare of the people of the
Borough at large, and such action shall in no way entitle the holders
of any season admission tickets or card to any refund therefor.
The governing body, the Mayor, the Director of Public Works,
the Board of Recreation or members of the Police Department of the
Borough shall have authority to prohibit any action or conduct which
may be considered dangerous, improper or in violation of the rules
and regulations promulgated by the Board of Recreation or in contravention
of this chapter, and each shall have the power to expel or suspend
the privileges otherwise granted to the holders of season admission
tickets or cards or their guests.
