It shall be unlawful for any person, firm, or corporation to connect into any portion of the water system of the Borough of Girard without first securing a written permit therefor from the Borough Secretary, which permit shall be issued upon the payment of a tap-in fee in such amount as may from time to time be established by resolution of the Borough Council. Current fees shall be on file with the Borough Secretary and shall be furnished upon request.
It shall be unlawful for any person, firm, or corporation to use any material other than that furnished by the Borough of Girard to connect into any portion of the water system of the Borough of Girard. Such material shall be furnished by the Borough of Girard at the expense of the person, firm or corporation desiring to make the connection into the water system.
Any person who violates or permits a violation of this article shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Borough before a Magisterial District Judge, pay a fine of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Borough in the enforcement of this article. No judgment shall be imposed until the date of the determination of the violation by the Magisterial District Judge. If the defendant neither pays nor timely appeals the judgment, the Borough may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Borough are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.

There is imposed upon the owners of, or the users of water in or on, all properties connected to the Girard Borough water system charges for the use of said system and purchase of water therefrom, payable in the amounts and as provided in the Water Rate Resolution of the Council of the Borough of Girard and as it is hereafter from time to time adopted, amended, and modified by Council. Said owners and users are jointly and severally liable for the payment of said water charges and the penalties therein prescribed for delinquent payment thereof.
All bills for water sold through the Borough water system shall be due when rendered and be subject to the penalty provisions set forth in the Borough's Water Rate Resolution. Owners and, where adequate arrangements have been made with Council, users will be billed periodically for the water distributed and sold through the Borough water system in accordance with the billing practices of the Borough.
The amount charged for water and any penalty added thereto as herein provided shall be a lien upon the real estate charged with the payment thereof, whether or not the original billing has been to the owner of the property or to a tenant thereof.
The Water Rate Resolution and as it is hereafter from time to time adopted, amended, or modified by Council shall be on file in the Borough Manager's office, with a copy thereof available to any owner, user, or potential owner or user of water purchased from the Borough of Girard.
