A. 
No person shall practice massage, or conduct an establishment for the giving of vapor, pool, shower, or other baths for hire or reward, or advertise or hold oneself out as being engaged in the business or occupation of massage or the giving of said baths without receiving a license therefor from the Commissioner of Public Health of the City.
B. 
The Commissioner shall have the authority to grant said license to qualified applicants upon such terms and conditions as he finds necessary and may make such rules and regulations in regard to said business or occupation as he finds proper; provided that, within 21 days after receipt of a formal application accompanied by a fee set annually by the Commissioner, the Commissioner shall conduct a hearing on the application.
C. 
Reasonable notice of the time and place of the hearing shall be given and the applicant may be represented by counsel of his choice and may present any witnesses or evidence material to the application.
The Commissioner shall, within 90 days from the close of the hearing, give a written decision whether to issue such license, containing a statement of reasons.
Any license issued under this chapter shall be valid for a period of one year from the date of issue and may be renewed by paying the fee set by the Commissioner.
A. 
If any licensee under this chapter fails to comply with the laws of the Commonwealth or with the rules and regulations of the Department of Public Health or with any other laws, ordinances, rules or regulations, the Commissioner may, after giving notice to the licensee informing him of the alleged violation, and after an opportunity for hearing, modify, suspend or revoke the license.
B. 
The decision shall be made within 21 days after the date of hearing and shall contain a statement of reasons.
No licensee shall practice massage upon a person of the opposite sex; nor shall a licensee give vapor baths to a person of the opposite sex.
A. 
Any person who violates any of the provisions of this chapter shall be punished by a fine not to exceed $300 for each offense.
B. 
Nothing in this chapter shall be construed as conflicting with any license issued under the authority of the Commonwealth.
