Editor's Note: Chapter 708 of the Laws of 1955 purported to establish the so-called "Bauer Line" as the boundary line between Garrett and Allegany County. By action in the Circuit Court of Allegany County, the Board of County Commissioners of Garrett County vs. Board of County Commissioners of Allegany County, Civil Action No. 01-C-07-028940-L, the Court declared Chapter 708 of the Laws of 1955 as unconstitutional and declared that the boundary line between Garrett and Allegany County is as described in the report of Daniel Chisholm, dated October 8, 1872. Reference to the opinion and order of the Court was made a more and detailed explanation as to the Court’s reasoning.
