All persons, businesses or entities which contribute wastewater to the North Branch Pumping Station and Force Main are hereby subject to the terms and conditions of the City of Cumberland's Wastewater Treatment Ordinance, known as "Ordinance No. 3251" or subsequent amendments thereto, and codified at §§ 24-201 through 24-254 of the Code of City of Cumberland (1991 Edition).
All contributors to the North Branch Pumping Station and Force Main who are determined to be required to have a wastewater contribution permit issued by the City of Cumberland and/or the Maryland Department of the Environment, pursuant to Ordinance No. 3251 or subsequent amendments thereto, or any other law or ordinance of the City of Cumberland, Allegany County, or the State of Maryland, shall obtain and possess a valid and current wastewater contribution permit issued by the City of Cumberland and/or the Maryland Department of the Environment as a condition to:
A. 
Obtaining a tap from Allegany County to connect to the North Branch Pumping Station and Force Main;
B. 
Continue to be connected to the North Branch Pumping Station and Force Main; and
C. 
Be allowed to contribute wastewater to the North Branch Pumping Station and Force Main.
Allegany County hereby assigns to the City of Cumberland and/or the Maryland Department of the Environment the right to enforce Ordinance No. 3251 or subsequent amendments thereto, to the same extent as if the North Branch Pumping Station and Force Main and its contributors were located within the boundaries of the City of Cumberland, upon the express condition that those contributors shall be granted the same rights and privileges for appeal and judicial review as provided for in Ordinance No. 3251 or subsequent amendments thereto, or provided to persons, businesses or entities resident within the City of Cumberland who are subject to said ordinance.
