Now therefore be it resolved, that the Board of Trustees of the Village of Geneseo finds as follows:
A. 
That the aforesaid petition[1] for annexation substantially complies in form and content with the General Municipal Law Article 17.

B. 
That the proposed annexation of certain territory in the Town of Geneseo to the Village of Geneseo as described in the aforesaid petition is in the overall public interest.
Now therefore it is ordered that the consent and approval of the Board of Trustees of the Village of Geneseo is hereby given to the annexation of the territory now situate in the Town and described in the aforesaid petition (Exhibit A) to the Village of Geneseo.
All that tract or parcel of land, situate in the Town of Geneseo, County of Livingston, State of New York, bounded and described as follows:
A. 
Beginning at a point on the center line of Reservoir Road (f/k/a Marlborough Road), said point being the intersection of the center line of Reservoir Road with the northerly extension of the assumed easterly street line of Haley Avenue, said point also being a northwest corner of Shepard Properties, LLC (Ref. Liber 1143 of Deeds at page 14); thence
(1) 
South 84° 30' 00" east and along the center line of Reservoir Road for a distance of 279.07 feet to a point; thence
(2) 
South 05° 18' 00" west for a distance of 33.00 feet to a point on the assumed southerly street line of Reservoir Road, said point also being the northwest corner of lands now or formerly of Robert B. Moses and Nancy L. Moses (Liber 392 of Deeds at page 159), thence continuing on the same course and along the westerly line of lands of said Moses for an additional 250.00 feet, making a total for this course of 283.00 feet from center line to a point said point being the northeast corner of lands now or formerly of May Ann Shepard (Liber 893 of Deeds at page 191); thence
(3) 
North 84° 30' 00" west and along the northerly line of lands of said Shepard for a distance of 73.14 feet to a point thence
(4) 
North 05° 06' 45" east for a distance of 130.00 feet to a point; thence
(5) 
North 84° 30' 00" west for a distance of 205.00 feet to a point on the assumed easterly street line of Haley Avenue, said point also being the apparent northwest corner of lands now or formerly of Mark Shepard (Liber 1121 of Deeds at page 148); thence
(6) 
North 05° 06' 45" east and along the assumed easterly street fine of Haley Avenue for a distance of 120.00 feet to a point on the assumed southerly street line of Reservoir Road, thence continuing on the same course for an additional 33.00 feet, making a total for this course of 153.00 feet to the center line of Reservoir Road and the point of beginning.
B.
Containing:
1.198 acres to center line.
0.987 acres to street tines.
C. 
Subject to an easement granted to Rochester Gas & Electric Corporation in Liber 41 or Miscellaneous Records at page 282 as noted on the survey map.
D. 
This conveyance is made and accepted subject to such other grants, easements, reservations, covenants, agreements, leases and restrictions of record in the Livingston County Clerk's Office, as may pertain to or affect the above described premises.
E. 
Being and intending to conveys portion of the same premises conveyed by Mary Ann Shepard to Shepard Properties, LLC by Quit Claim Deed dated September 23, 2003, and recorded in the Livingston County Clerk's Office on September 8, 2004, in Liber 1143 of Deeds at page 14.
F. 
All as shown on a map entitled "Map of a Survey showing a portion of Lands Belonging to and to be Conveyed by Shepard Properties, LLC," prepared by Donald R. Thomas, Land Surveyor, dated August 11, 2009, and designated as Job No. L5-09-11, to be filed in the Livingston County Clerk's Office simultaneously herewith.
