The Town of Onondaga has seen increased use of portable on-site deliverable storage units (PODS). In many instances, PODS have been left in driveways and on properties for extended periods of time, acting as virtual permanent storage sheds for the owners of the property. While these portable units can serve a useful purpose for short-term storage, they are generally unsightly can have a negative impact on adjoining properties and long-term storage needs should be met by construction of a permanent accessory storage facility, meeting all of the requirements of the Town's zoning and building codes.
As used in this chapter, the following terms shall have the meanings indicated:
PORTABLE ON-SITE DELIVERABLE STORAGE UNITS
A container, transportable or portable structure or unit designed and used primarily for storage of building materials, household goods, personal items and other materials outside an enclosed building, other than an accessory building or shed complying with all building codes and land use requirements.
Portable on-site deliverable storage units (PODS) are permitted to be on a property for a period of time not to exceed 14 days. The use of such units shall be limited to no more than twice during any twelve-month period.
These restrictions shall apply to all portable on-site deliverable storage units located in the Town of Onondaga on and after the effective date of this chapter.

A. 
Violation of this chapter is hereby declared to be an offense, punishable by a fine not exceeding $350 or imprisonment for a period not to exceed 15 days, or both, for conviction of a first offense; for conviction of a second offense both of which were committed within a period of five years, punishable by a fine of not less than $350 nor more than $700 or imprisonment for a period not to exceed 15 days, or both; and upon conviction of a third or subsequent offense, all of which were committed within a period of five years, punishable by a fine of not less than $700 nor more than $1,000 or imprisonment for a period not to exceed 15 days, or both. However, for the purpose of conferring jurisdiction upon the courts and judicial offices generally, violations of this chapter shall be deemed misdemeanors, and for such purpose only all provisions of law relating to misdemeanors shall apply to such violations. Each week's continued violation shall constitute a separate and distinct violation.
B. 
In case of any violation of this chapter, the Town Board of the Town of Onondaga, New York, in addition to other remedies, may institute any appropriate action or proceedings in law or in equity to prevent such violation.
