Adoption of the ICC Property Maintenance Code, 2009 Edition: That certain document, three copies of which are on file in the administrative offices of the Spring Garden Township, being marked and designated as the "ICC Property Maintenance Code, 2009 Edition", is hereby adopted as the Property Maintenance Code of Spring Garden Township, in the Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings, structures by: providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use and for the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; repealing Ordinance No. 2007-14; and each and all of the regulations, provisions, conditions and terms of such ICC Property Maintenance Code, 2009 Edition, published by the International Code Council, on file in the office of Spring Garden Township are hereby referred to, adopted, and made a part hereof as if fully set out in this article.
The following sections of the ICC Property Maintenance Code, 2009 Edition, are hereby revised:
A. 
Section 101.1. Insert "Spring Garden Township."
B. 
Section 103.5. Insert "Fee schedule as passed by resolution of the Spring Garden Township Board of Commissioners."
C. 
Section 106.4. Replace section as follows:
Section 106.4 Violation penalties. Any person who shall violate a provision of this code, or fail to comply therewith or with any of the requirements thereof, shall, upon conviction thereof before any Magisterial District Judge in a summary proceeding, be sentenced for each such violation to pay a fine not exceeding $1,000 and costs of such proceedings and, in default thereof, to undergo imprisonment for a period not exceeding 30 days. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
D. 
Add new:
Section 110.5 Excavation replacement. After removal of any building or structure, any excavation hereunder shall be refilled with earth or other suitable material.
E. 
Section 112.4. Replace section as follows:
Section 112.4 Failure to comply. Any person who shall continue any work after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to Section 106.4 Violation penalties.
F. 
Section 302.4. Insert "six inches."
G. 
Add new:
Section 302.4.1 Landscaping. Trees, hedges, bushes and other landscaping shall be kept trimmed and shall not be permitted to become overgrown or unsightly.
H. 
Add new:
Section 302.7.1 Affixed accessory structures. All accessory structures shall be securely affixed and anchored to a foundation that would prevent buildings from being blown away from their location by high winds and moved or removed by vandals.
I. 
Add new:
Section 302.10 Storage. Equipment and material relating to commercial or industrial uses shall not be stored or used at a location visible from the sidewalk, street, other public areas or adjoining properties.
302.11 Furniture. Interior-type furniture which would be adversely affected by the elements and/or susceptible to infestation by insect, rats or other vermin is prohibited from being placed in the exterior property or on any porch. Such prohibited furniture shall include, but is not limited to, upholstered couches and chairs or other fabric-covered articles, including beds/mattresses, not designed or intended for exterior use.
