All installations of outdoor chemical toilets, commonly referred to as "jiffy johns," for temporary use in connection with construction activities, athletic events and outdoor social activities, shall require the securing of a permit from the Spring Garden Township Zoning Officer.
Chemical toilets shall meet the design specifications of the manufacturer, provided that such specifications allow for a safe and sanitary operation and preclude any potential for health hazards, and the design of chemical toilets shall be of a type approved by the Pennsylvania Department of Environmental Protection. If it remains or is to remain more than six months, whether by permit or permit and renewal, it shall be installed no less than 200 feet from any dwelling house or building of human habitation. If it is to remain less than six months, it shall be no less than 75 feet from any dwelling house or building of human habitation, except that where it is not possible to obtain the 75 feet distance, it must be at the farthest possible distance but in any event no less than 50 feet.
The permit for the installation of such outdoor chemical toilets shall be limited to a period of not more than one year, at which time it will be necessary to reapply for a renewal of the permit.
The applicant shall pay a fee as established from time to time by the Board of Commissioners at the time of the filing of the application and shall be subject to a similar fee for each renewal of the permit.
Any person violating any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not less than $50 nor more than $1,000 and costs of prosecution and, in default of payment of said fines and costs, shall be sentenced to a term of imprisonment not to exceed 30 days. Each day a violation continues shall be deemed a separate offense.
