A. 
There is hereby established in the Township a mandatory collection, transportation and disposal program for the collection, transportation and disposal of municipal wastes from residential dwelling units. The Township is authorized to promulgate such rules and regulations as are necessary to implement the collection, transportation and disposal program for municipal waste from residential dwelling units. The Township is authorized to enter into a contract with a contractor for the collection, transportation, disposal and billing of municipal waste, which contract shall contain such terms and conditions as the Township shall deem appropriate.
B. 
Each person owning or occupying a dwelling unit within the Township is required to participate in the mandatory municipal waste disposal program and shall have all municipal waste and recyclables collected, transported and disposed of by the contractor selected by the Township to collect, transport and dispose of all municipal waste generated within the Township. It shall be unlawful for any person to accumulate ashes, garbage, municipal or other solid waste and other refuse materials upon private property.
C. 
The following rules and regulations are adopted for the collection of garbage and other refuse in Spring Garden Township:
(1) 
All organic garbage shall be placed in watertight, metal or plastic can containers with a secure lid or covering thereon, or in heavy-duty plastic refuse bags or sacks, none of which containers, with contents, shall weigh more than 50 pounds.
(2) 
All inorganic garbage consisting of ashes, paper, cans, yard cleanings, etc., shall be placed in suitable metal or plastic containers that are not likely to spill or scatter the contents onto the street or alley. Nail kegs, wood barrels, steel drums, cardboard containers and paper bags shall not be considered suitable containers and shall not be used. No container shall weigh more than 50 pounds filled.
(3) 
The accumulation on private property of animal or vegetable matter that will attract flies, rodents or other vermin is prohibited.
(4) 
Except during the period scheduled for garbage, recycling or leaf waste removal, it shall be unlawful to throw or place tree, hedge, shrubbery or grass trimmings, paper, trash or litter of any kind or description into or upon the dedicated right-of-way of any of the streets or alleys or upon the land reserved for public use within the said Township.
(5) 
Filled containers shall not be placed on the curb side of the sidewalk or in the rear alley (wherever the garbage is scheduled for collection) earlier than 6:00 p.m. on the evening preceding the day scheduled for collection.
(6) 
Empty containers must be removed from sidewalks and alleys within 12 hours from the time the collection is made, if collection is made on the scheduled day.
(7) 
A large-item pickup shall be held once a week in Spring Garden Township, the date to be set by the Board of Commissioners at a regular meeting. In the alternative, the Board of Commissioners may provide for an alternate method of large-item pickup as set forth from time to time in the specifications for garbage and refuse collection bid and awarded from time to time by the Board of Commissioners.
(a) 
The Township will not pick up any hazardous waste, cardboard boxes loaded with material, brush, logs, paint, construction or remodeling debris, tires, excessive white goods or business refuse of any kind. "Hazardous waste" shall include, but not be limited to, oils, solvents, cleaners and detergent, other liquids and any other waste which is not acceptable to any municipal waste disposal facility in York County, Pennsylvania. "Excessive white goods" are more than one each of the following: water heater, freezer, refrigerator, sink, washer, dryer or stove.
(b) 
Any large item set out for collection prematurely or late, or which is ineligible and therefore is refused for pickup, must be removed from the collection point within 48 hours or the person placing same, or the owner of the premises, shall be thereafter notified by phone or, if necessary in writing, by the Township to remove the items. If the items are not voluntarily removed within 24 hours after the written notice, the owner and/or the person placing the items for pickup shall be penalized as hereinafter provided.
(c) 
All municipal solid waste from residential units, multifamily units, commercial, institutional and municipal establishments shall be delivered to the disposal facility designated by the York County Solid Waste Authority.
(8) 
The collection of any garbage and refuse shall be limited to the hours between 7:00 a.m. and 7:00 p.m.

A. 
Anything in this article notwithstanding, it shall be unlawful for any person to deposit, place, leave or cause to be placed, left or dumped any garbage, ashes, refuse or items or containers of any kind for refuse collection on any premises within Spring Garden Township and to leave the same with an owner or tenant in possession of said premises.
B. 
It shall be unlawful for the owner of any premises or tenant in possession of any premises to permit the placement of any garbage, refuse, items or containers of any kind for refuse collection by any person who is not a resident of Spring Garden Township or to bring such items into the Township for refuse collection.

Any person who should violate this article shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 or more than $600 and cost of prosecution and, in default of payment of such fine and costs, to imprisonment of not more than 30 days, provided each violation of any provision of this article and each day the same is continued shall be deemed a separate offense.
