This article is enacted pursuant to authority contained in Article 7 of the Agriculture and Markets Law of the State of New York.
The purpose of this article is to provide for the licensing and identification of dogs, to further the control and protection of the dog population and the protection of persons, property, and domestic animals from incidents involving dogs.
A. 
All dogs harbored within the Town of Yorktown that are four months of age or older, unless otherwise exempted, shall be licensed by the Town Clerk.
B. 
The owner of each dog required to be licensed shall submit to the Town Clerk a dog license application on a form provided by the Town Clerk, together with the license application fee, any applicable license surcharges and such additional fees as may be established by the Town of Yorktown.
C. 
Each license application shall be accompanied by proof that the dog has been vaccinated against rabies or a statement from a licensed veterinarian that such vaccination would endanger the dog's life, in which case vaccination shall not be required. Each license issued shall be valid for a period of one year and shall not be transferable.
A dog owned by a resident of any city having a population of over two million or by a nonresident of New York State that is harbored within the Town shall be exempt from this requirement for a period of 30 days, after which time the owner shall be required to obtain a license from the Town.

The Town of Yorktown hereby establishes the fees for dog licenses as follows:
A. 
For a neutered or spayed dog: an amount as set forth in the Master Fee Schedule.[1] The application shall be accompanied by a certificate signed by a licensed veterinarian or an affidavit signed by the owner, showing that the dog has been spayed or neutered, or by a health waiver certificate signed by a licensed veterinarian stating that the veterinarian has examined the dog and found that because of old age or other reason, the life of the dog would be endangered by spaying or neutering. The license fee set forth in this subsection includes a population control state surcharge as required pursuant to § 110, Subdivision 3, of the State Agriculture and Markets Law.

B. 
For a dog that is not neutered or spayed, and as to which a health waiver certificate has not been submitted in accordance with Subsection A above: an amount as set forth in the Master Fee Schedule.[2] The license fee set forth in this subsection includes a population control state surcharge for a dog that has not been neutered or spayed, as required pursuant to § 110, Subdivision 3, of the State Agriculture and Markets Law.

C. 
Excepted from payment of the license fee are applications for a dog license for any guide dog, hearing dog, service dog, war dog, working search dog, detection dog, police work dog or therapy dog, as defined in Article 7 of the Agriculture and Markets Law.
D. 
In addition to fees set forth above, any person applying for an initial dog license whose dog was identified as unlicensed by the Town's dog control officer or other authorized agent during an enumeration program shall pay a fee in an amount as set forth in the Master Fee Schedule.[3]

Notification of a change in the ownership of a dog, or of the loss of a dog, shall be given within 10 days of such ownership change or loss, to the Town Clerk in writing. The owner of a dog shall be liable for any violation of this chapter of the Town Code until such filing has been made or until the dog has been relicensed in the name of the new owner. Failure to notify the Town Clerk of a change of ownership is a violation of Article 7 of the State Agriculture and Markets Law.
