The International Property Maintenance Code, 2009 Edition, as published by the International Code Council, and any amendments promulgated hereafter by the International Code Council, is hereby adopted as the Property Maintenance Code of Doylestown Township, Bucks County, Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use; and demolition of such existing structures as herein provided.
A. 
The provisions of Chapter 1, Administration, Part 1, Scope and Application, Section 101, General, Subsection 101.1, Title, are hereby amended by referencing that the name of the jurisdiction is Doylestown Township.
B. 
The provisions of Chapter 1, Scope and Administration, Section 103, Department of Property Maintenance Inspection, Subsection 103.5, Fees, are amended by deleting the Subsection as set forth therein and in lieu thereof providing as follows:
103.5 Fees. The fees for activities and services performed by the Department carrying out its responsibilities under this Code shall be in accordance with the Township fee schedule adopted from time to time by the Township Board of Supervisors.
C. 
The provisions of Chapter 1, Scope and Administration, Part 2, Administration and Enforcement, Section 106, Violations, Subsection 106.3, Prosecution of Violations, are herein amended by deleting the provisions as set forth therein and in lieu thereof providing as follows:
106.3 Prosecution of Violation. Any person failing to comply with a notice of violation or order served in accordance with Section 107 shall be deemed guilty of a summary offense and shall be subject to such penalties as are set forth in Section 106.4. If the notice of violation is not complied with, the Township may institute the appropriate proceedings in law or equity to restrain, correct or abate such violation or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this Code or of the order of direction made pursuant thereto. Any action taken by the Township having jurisdiction over such premises shall be charged against the real estate upon which the structure is located and shall be lien upon such real estate as permitted by law.
D. 
The provisions of Chapter 1, Scope and Administration, Part 2, Administration and Enforcement, Section 111, Means of Appeal, Subsection 111.1, are hereby amended such that the Board of Appeals required to be appointed pursuant to the provisions of this Code may be the same Board of Appeals as established by the Township for other Codes adopted by the Township, provided the qualifications of the Board of Appeals meets the requirements of Section 111.2.
E. 
The provisions of Chapter 3, General Requirements, Section 302, Exterior Property Areas, Subsection 302.4, Weeds, shall be amended by inserting the words "eight (8) inches" in height.
F. 
The provisions of Chapter 3, General Requirements, Section 304, Exterior Structure, Subsection 304.14, are amended by inserting the dates from May 1 to and including September 30.
G. 
The provisions of Chapter 6, Mechanical and Electrical Requirements, Section 602, Heating Facilities, Subsection 602.3, are amended by inserting the dates September 1 through June 15.
H. 
The provisions of Chapter 6, Mechanical and Electrical Requirements, Section 602, Heating Facilities, Subsection 602.4 are amended by inserting the dates September 1 through June 15.
Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impeding in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 128-2B of this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
