Garbage, rubbish and refuse — See Ch. 39.
It has come to the attention of the Village Board of Trustees that individuals, persons and organizations have been dumping garbage and refuse onto the streets of Huntington Bay and onto various properties located within the Village of Huntington Bay. These materials are not only unsightly and create a nuisance to the public at large but also represent a potential health hazard. Therefore, the Village Board of Trustees wishes to implement this chapter to prohibit improper and illegal dumping in the Village.
For the purposes of this chapter, the following terms shall have the meanings provided in Chapter 13 of the Village Code: garbage; junked vehicle, boat or household appliance; litter; refuse; and rubbish.
No person shall throw, deposit or spill or cause to be thrown, deposited or spilled any garbage, litter, refuse, rubbish or abandoned vehicles, boats or household appliances or any liquid or parts thereof in any public highway, street or public or private place in the Village.
Provisions hereof shall not apply to garbage or rubbish stored or kept outside on the days of the year designated by the Village for the pickup of garbage or rubbish.
The Building Inspector of the Village and the Village Police Department are hereby authorized to issue appearance tickets for violations of this chapter.

Each offense against the provisions of this chapter or article shall constitute a violation pursuant to the Penal Law of the State of New York and shall be punishable as such. Any person or persons violating any provisions of this chapter or article shall be liable for and pay a fine of not less than $50 and not more than $1,000 for a conviction on each offense.

If any part or provision of this chapter or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this chapter or the application thereof to other persons or circumstances, and the Board of Trustees of the Incorporated Village of Huntington Bay hereby declares that it would have passed this chapter or the remainder thereof had such invalid application or invalid provision been apparent.
