No person or persons, firm, association or corporation shall
hawk, sell or dispose of or offer to sell or dispose of or peddle
commodities, goods, wares, merchandise or magazines or solicit trade
or subscriptions within the Village of Huntington Bay without first
obtaining a license therefor. Application for such license shall be
filed with the Village Clerk. Such license shall be issued by the
Board of Trustees of the Village to such persons as it shall deem
fit and proper upon payment to the Village of a fee of $50. Every
such license shall be countersigned by the Clerk of the Village, who
shall keep a record thereof and the amount of the fee paid therefor
and shall deliver a copy of said license to the Chief of Police of
the Village. All licenses shall expire at the end of the calendar
year in which they are issued.
This chapter shall not apply to any person whom this Village
may not, pursuant to the laws of the State of New York, prohibit from
hawking or peddling.

Each offense against the provisions of this chapter or article
shall constitute a violation pursuant to the Penal Law of the State
of New York and shall be punishable as such. Any person or persons
violating any provisions of this chapter or article shall be liable
for and pay a fine of not less than $100 and not more than $250 for
a conviction on each offense.

If any part or provision of this chapter or the application
thereof to any person or circumstance be adjudged invalid by any court
of competent jurisdiction, such judgment shall be confined in its
operation to the part or provision or application directly involved
in the controversy in which such judgment shall have been rendered
and shall not affect or impair the validity of the remainder of this
chapter or the application thereof to other persons or circumstances,
and the Board of Trustees of the Incorporated Village of Huntington
Bay hereby declares that it would have passed this chapter or the
remainder thereof had such invalid application or invalid provision
been apparent.
