For purposes of this article, the words "municipal civil infraction"
shall mean an act or omission that is prohibited by an ordinance of
the Charter Township of Cascade, but which is not a crime under the
particular ordinance involved, and for which civil sanctions, including,
without limitation, fines, damages, expenses and costs, may be ordered,
as authorized by Chapter 87 of Act No. 236 of the Public Acts of 1961,
as amended, and Public Acts 12-26 of 1994, as amended. A municipal civil infraction is not a lesser included
offense of a violation of a Township ordinance that is a criminal
offense.
Persons chargeable with a violation of an ordinance and subject
to being responsible for a municipal civil infraction may include
the following:
A. The owner, agent, lessee, tenant, contractor or any other person
using or having control or possession of the land, building or premises
where such violation has been committed or shall exist;
B. Any person who knowingly commits, aids and abets, takes part or assists
in any such violation; or
C. Any person who owns or maintains any land, building, or premises
on which such violation shall exist.
