As used in this article, the following words and phrases shall mean:
BOARD or BOARD OF SUPERVISORS
The Board of Supervisors of the Township of North Codorus, York County, Pennsylvania.
SNOW EMERGENCY
A weather condition where snow, ice, sleet, freezing rain, or a combination of them accumulates on the streets of the Township sufficiently to constitute a complete covering of said streets.
SNOW EMERGENCY OFFICIAL
The Chair of the Township's Board of Supervisors or, in his or her absence, the Vice Chair, or other person so designated by the Board of Supervisors.
SNOW EMERGENCY ROUTE
Any street or road in the Township so designated in this article or subsequent amendments.
TOWNSHIP
The Township of North Codorus, York County, Pennsylvania.
In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in § 162-17 of this Article III, the Snow Emergency Official, in his or her discretion, may declare a snow emergency. Information on the existence of the snow emergency may be given by the Township of North Codorus through radio, newspaper or other available media, and information on the termination of the snow emergency may be given by use of the same media. For administrative purposes, such declaration of a snow emergency shall be announced at the next duly advertised public meeting of the Township's Board of Supervisors for the official minutes. Failure to so announce a snow emergency shall not constitute a defense to a violation of this article.
After a snow emergency is declared by the Snow Emergency Official, it shall be unlawful at any time during the continuance of the snow emergency for any person to park or allow to stand a motor vehicle or to allow that vehicle to remain parked or standing anywhere on any snow emergency route designated in § 162-17 of this Article III.
All streets within the Township, including, for streets that extend beyond the boundaries of the Township, the entire portion of the street that is located within the Township, are hereby declared to be snow emergency routes, except those roads exempted by § 161-18.
The following streets are exempted from designation as snow emergency routes within the Township:

In the event a motor vehicle is parked or left standing on or within the right-of-way of a Snow Emergency Route in violation of this article, the Township Board of Supervisors or its designee, including the Roadmaster, or any police department with jurisdiction within the Township, shall have the authority to remove or cause the removal of such motor vehicle to a place designated by the Township. Prior to the owner of such motor vehicle regaining possession of said vehicle, or upon assessment of a penalty pursuant to § 161-21 of this article, the owner shall pay to the Township the costs incurred by the Township in causing such removal and storage, and in addition thereto, pay to the Township the penalty prescribed by § 161-21 of this article.
The Township, its employees and contractors shall have no liability for any damage to any motor vehicle parked in violation of this article occurring to such motor vehicle by reason of Township's removal of such vehicle from its parking location, and/or by reason of the Township's road maintenance and/or snow removal activities or operations.
Any person, corporation, partnership or association found in violation of any of the provisions of this article shall, upon conviction thereof by a District Magisterial Judge (formerly known as District Justice), in a summary proceeding, be sentenced to pay a penalty of $25, together with all costs as set forth in this article, in the Pennsylvania Motor Vehicle Code, and other state laws applicable to summary offenses. Each day that this article is violated shall constitute a separate and distinct offense, and shall be subject to separate and distinct penalties.
Upon the effective date of this article, or upon a subsequent change of designation of any streets as snow emergency routes, the Township shall notify Township residents by placing a notice in the next Township newsletter after the adoption of this article, and shall also place such notice on the Township's website. Such notice shall serve as sufficient legal notice to any and all residents of, or guests of residents of, the Township of the provisions of this article.
The provisions of this article are severable, and if any provision is determined by a court of competent jurisdiction to be unlawful or unenforceable, all other provisions of this article shall be given their full weight, as though the unlawful or unenforceable provision were deleted.
