No person, company of persons or corporation shall exhibit any circus or theatrical presentation, nor shall any person permit any place to be used for such purpose within the City of Fulton without having obtained a license as required by the provisions of § 306-2 of this chapter.

The Mayor may, in his discretion, upon the application of any person and upon the payment of any fees specified, issue to the person applying therefor a license to do any of the acts mentioned in § 306-1 of this chapter, and the Chief of Police is hereby authorized and empowered to issue, at his discretion, upon written application therefor, stating the time and place thereof, a permit for a public dance to be held in accordance herewith.

No person, company of persons or corporation shall exhibit, present or participate in any exhibition, carnival, show or entertainment in the City of Fulton other than a circus or theatrical presentation, nor shall any person or company of persons or corporation permit any place to be used for such purposes within the City of Fulton.

Any organization wishing to enter City limits with rides and food concessions shall be permitted to make application for a license, and the same shall be granted if found to conform to this chapter.

A. 
No circus, carnival or other public event may make use of any properties owned by the City of Fulton, including but not limited to the public parks of the City, without first obtaining authorization for such use from the Common Council of the City of Fulton.
B. 
Any person, firm or corporation desiring such permission shall make application to the Clerk/Chamberlain of the City of Fulton who shall present said application to the Common Council at the next meeting thereof following the date of such application.

No license or permit issued hereunder shall permit any performance or exhibition on Sunday, except the exhibition of moving pictures, unless specifically provided otherwise herein, and no license shall be transferred without the written consent of the Mayor endorsed thereon.
Any violation of this chapter shall be punishable by a fine of not less than $5 nor more than $200 and imprisonment in the jail of Oswego County until said fine is paid, not exceeding one day for each dollar of fine imposed.
