For the purpose of this chapter, the identified floodplain area
shall be those areas of the Borough which have been identified as
being subject to flooding by a one-hundred-year flood. These areas
are shown as the "AE" and "A" Areas on the Flood Insurance Study (FIS)
prepared for the Borough by the Federal Emergency Management Agency
(FEMA), dated May 4, 1989, or the most recent revision thereof. In
those areas where the FIS has not provided one-hundred-year flood
elevations, elevation and floodway information from other federal,
state or other acceptable sources shall be used when available. Where
other acceptable information is not available, the elevation shall
be determined by using the elevation of a point on the boundary of
the identified floodplain area which is nearest the construction site.
The identified floodplain area may be revised or modified by
the Borough Council where studies or information provided by a qualified
agency or person documents the need for such revision or modification.
However, prior to any such change, approval must be obtained from
the Federal Insurance Administration.
Should a dispute concerning any identified floodplain boundary
arise, any party aggrieved by such determination may appeal to the
Borough Council. The burden of proof shall be on the appellant.
