A. 
A number of commercial premises in Maine offer nude dancing and other nude performances as a form of public entertainment.
B. 
Recently, there has been an interest in locating such an establishment in the Town of Madison.
C. 
The types of nude entertainment offered by such establishments and regulated by this chapter are a purely commercial activity, unrelated to free expression and the exchange of ideas.
D. 
Unlimited commercial exploitation of nudity can induce individuals to engage in prostitution, sexual assaults, breaches of the peace and other criminal activity.
E. 
Persons under the age of 18, by reason of their age and inexperience, are especially susceptible to prostitution and other criminal activity if employed by or allowed entrance as patrons of commercial premises offering nude entertainment.
F. 
Commercial premises offering nude entertainment should be sited in locations that minimize their negative effects on public health, safety and welfare.
The purpose of this chapter is to regulate nudity as a form of commercial exploitation and to regulate dress as a form of conduct and not to impede the free exchange and expression of ideas. In view of the foregoing legislative findings, and for the purpose of protecting the public health, safety and welfare, the Town of Madison hereby adopts the following regulations of commercial nudity.
