[Adopted 6-26-1984 by L.L. No. 15-1984 (Ch. 222, Art. I, of the 1985 Code)]
This Legislature hereby finds that the theft of boats and marine motors has increased dramatically in the past several years. Therefore, the purpose of this article is to discourage such criminal activity by prohibiting concealment activities which enhance the marketability of such items.
As used in this article, the following terms shall have the meanings indicated:
MARINE HULL
Any boat, regardless of its means of propulsion.
MARINE MOTOR
The source of power, other than propulsion by wind-propelled sail or human-propelled oar or paddle, which mechanically propels a boat.
PERSON
Any individual, corporation, unincorporated association, partnership, joint venture or joint-stock association.
No person shall:
A.
Willfully remove, deface, cover, alter or destroy the manufacturer's serial number or other distinguishing number or identification mark on any marine motor or marine hull.
B.
Knowingly buy, sell, receive, dispose of, conceal or knowingly have in his possession any marine motor or marine hull from which the manufacturer's serial number or any other distinguishing mark or identification mark has been removed, defaced, covered, altered or destroyed for the purpose of concealment or misrepresenting the identity of said marine motor or marine hull.
Any violation of this article shall be punishable as a Class A misdemeanor.
