A certain document, three copies of which are on file in the office of the Code Enforcement Officer of Londonderry Township, Dauphin County, Pennsylvania, being marked and designated as the International Property Maintenance Code, 2018 Edition, as published by the International Code Council, as amended and supplemented, be and is hereby adopted as the Property Maintenance Code of Londonderry Township, Dauphin County, Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupancy and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such existing structures as herein provided; and providing for the issuance of permits and collection of fees therefor. Each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Code Enforcement Officer of Londonderry Township are hereby referred to, adopted, and made a part hereof, as if fully set out in this Part, with the additions, insertions, deletions and changes, if any, prescribed in §
5-202 of this Part.

The following sections of the International Property Maintenance
Code, 2018 Edition, as published by the International Code Council,
are hereby revised as follows:
1. Section 101.1. Insert: Londonderry Township, Dauphin County, Pennsylvania.
2. Section 103.5 is revised to read as follows:

103.5. Fees - The fees for activities and services
performed by the Office of Code Enforcement in carrying on its responsibilities
under this code shall be set from time to time by resolution of the
Board of Supervisors of Londonderry Township.

3. Section 112.4. Insert: $500 or more than $1,000.
4. Section 302.4. Insert 10 inches and amend to add another paragraph
to read as follows: Furthermore, all properties within 10 feet of
a Township road right-of-way, or within the right-of-way of a Township
road, including all fence rows, shall be maintained free from weeds,
plant or tree growth, tree and shrub growth in excess of 10 inches,
if, in the opinion of the Township Road Foreman, the lack of said
maintenance would impair sight distance for driving along the Township
roads.
5. Section 106.4, Violation and Penalties, shall be amended to read
as follows:

Section 106.4. Violation and Penalties. Any person,
firm or corporation who shall violate any provision of this Part,
upon conviction thereof before a Magisterial District Judge in the
manner provided for the enforcement of summary offenses under the
Pennsylvania Rules of Criminal Procedure, shall be subject to pay
a fine of not more than $1,000 plus costs and reasonable attorneys
fees, and, in default of payment of said fines, costs and reasonable
attorneys fees, to a term of imprisonment not to exceed 90 days. Each
day that a violation of this Part continues, or each Section of this
Part that shall be found to have been violated, shall constitute a
separate offense.

6. Section 304.14. Insert: May 1 to October 15.
7. Section 602.3. Insert: October 1 to May 16.
8. Section 602.2. is hereby amended to read as follows:

Section 602.2. Residential Occupancies. Every dwelling
shall be provided with heated facilities capable of maintaining a
room temperature of 65° F. (18° C.) at a level of three feet
(914 mm) above the floor and a distance of three feet (914 mm) from
the exterior walls in all habitable rooms, bathrooms and toilet rooms
based on the outside design temperature required for the locality
by the mechanical code that is based on the wind or outdoor design
temperature of the locality indicated in Appendix D of the International
Plumbing Code. Cooking appliances shall not be used to provide space
heating to meet the requirements of this section.

Every owner and operator of any building who rents, leases,
or lets one or more dwelling units, rooming units, dormitories or
guest rooms, on terms either express or implied, to furnish heat to
the occupants thereof shall supply sufficient heat during the period
of October 1 through May 15 to maintain a room temperature of not
less than 65° F. (18° C.) in all habitable rooms, bathrooms
and toilet rooms during the hours between 6:30 a.m. and 10:30 p.m.
of each day and not less than 60° F. (16° C.) during other
hours. Temperature shall be measured at three feet (914 mm) above
the floor and three feet (914 mm) from the exterior walls. When the
outdoor temperature is below the outdoor designed temperature required
for the locality by Appendix D of the International Plumbing Code,
the owner or operator shall not be required to maintain the minimum
room temperatures, provided the heating system is operating at full
capacity, with supply valves and dampers in a full open position.

9. Section 602.4 is hereby amended as follows:

Section 602.4. Heating Facilities in Nonresidential Structures. Every enclosed occupied workspace shall be supplied with sufficient
heat during the period of October 1 to May 15 to maintain a temperature
of not less than 65° F. (18° C) during all working hours.
The temperature shall be measured at a point three feet (914 mm) above
the floor and three feet (914 mm) from the exterior walls.

Exceptions.
|
|
1.

Processing, storage and operation areas that require cooling
or special temperature conditions.
|
|
2.
|
Areas in which persons are primarily engaged in vigorous physical
activities.

10. A new Section 602.6 shall be added to read as follows:

Section 602.6. Outdoor Wood-Burning Furnaces. Outdoor wood-burning furnaces are hereby regulated by Part 9 of Chapter 5, Code Enforcement, of the Code of Ordinances of the Township of Londonderry.

11. The term "Code Official" shall be replaced with the term "Code Enforcement
Officer" wherever noted within the International Property Maintenance
Code of 2018, as amended and supplemented.

If any section, subsection, sentence, clause or phrase of this
Part is, for any reason, held to be unconstitutional, such decision
shall not effect the validity of the remaining portions of this Part.
The Board of Supervisors of Londonderry Township hereby declares that
it would have passed this Part, and each section, subsection, clause
or phrase thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared unconstitutional.

Nothing in this Part or in the Property Maintenance Code hereby
adopted shall be construed to effect any suit or proceeding pending
in any court or any rights acquired, or liability incurred, or any
causes of action acquired or existing under any act or ordinance hereby
repealed by this Part; nor shall any just or legal right or remedy
of any character be lost, impaired or affected by this Part.

This Part and the rules, regulations, provisions, requirements,
orders and matters established and adopted hereby shall take effect
and be in full force and effect from and after the date of its final
passage and adoption.
