As used in this chapter, the following terms shall have the
meanings indicated:
Any sale advertised for a special date and held by a private
individual or a non-profit organization at any location in town.
No person shall conduct a yard sale, tag sale, garage sale,
estate sale, moving sale or any such sale so called without a permit
issued by the Town Clerk.
A.
Any town resident desiring a permit to conduct a yard sale, tag sale,
garage sale, estate sale, moving sale or any such sale shall apply
for the permit at the Town Clerk's office.
B.
The applicant shall state his name and residence, together with the
date and location of the intended yard sale, tag sale, garage sale,
estate sale, moving sale or any such sale.
The Town Clerk shall issue a license permit to a person applying
for the permit required herein. Such person shall pay to the town
the fee of $5.00 per day; provided, however, that no more than six
permits shall be issued in any one calendar year to any one person
for any one location.
The permit required by the provisions of this chapter shall
be issued only to taxpayers and residents of the town.
A person to whom a permit is issued in accordance with this
chapter shall be allowed to place a sign advertising said yard sale,
tag sale, garage sale, estate sale, moving sale or any such sale on
the premises in question no larger than 18 inches by 24 inches, and
said sign shall not be placed on the premises earlier than seven days
prior to the date scheduled for the yard sale, tag sale, garage sale,
estate sale, moving sale or any such sale and must be removed at the
conclusion thereof.
No yard sale, tag sale, garage sale, estate sale, moving sale
or any such sale shall be conducted except on the day specified on
the required permit.
No yard sale, tag sale, garage sale, estate sale, moving sale
or any such sale shall be conducted at any time other than between
8:00 a.m. and 5:00 p.m.
Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be punished, for each violation, by a fine
of not more than $50.00. The continuation of a violation of any provision
of this chapter shall constitute, for each day the violation is continued,
a separate and distinct violation hereunder.
