The Uniform Traffic Code for Cities, Townships
and Villages promulgated by the Director of State Police and published
in the 1979 Edition of the Michigan Administrative Code and Amendments
as published in the Quarterly Supplement No. 5 to the 1979 Edition
of the Michigan Administrative Code, in accordance with Public Act
62 of 1956, State of Michigan, is hereby adopted by reference as in
this article modified.
References in the Uniform Traffic Code for Michigan
Cities, Townships and Villages to "governmental unit" shall mean the
Township of Grosse Ile, Wayne County, Michigan.
The Township Clerk shall publish this article
in the manner required by law and shall at the same time publish a
supplementary notice setting forth the purpose of said Uniform Traffic
Code and of the fact that a complete copy of the code is available
at the office of the Clerk for inspection by the public at all times.
A.
Sections 5.15 through 5.15g., both inclusive, of the
Uniform Traffic Code are hereby deleted and otherwise are hereby amended
and modified to read as follows:

B.
Operating under influence of intoxicating liquor or
a controlled substance, per se violation.

Section 1. Definition of "operate" or "operating."

"Operate" or "operating" means being in actual
physical control of a vehicle regardless of whether or not the person
is licensed under the Michigan Vehicle Code as an operator or chauffeur.

Section 2. A person, whether licensed or not,
who is under the influence of intoxicating liquor or a controlled
substance, or a combination of intoxicating liquor and a controlled
substance, shall not operate a vehicle upon a highway or other place
open to the general public, including an area designated for the parking
of vehicles, within the Township. A peace officer may, without a warrant,
arrest a person when the peace officer has reasonable cause to believe
that the person was, at the time of an accident, the driver of a vehicle
involved in the accident and was operating the vehicle upon a public
highway or other place open to the general public, including an area
designated for the parking of vehicles, in the Township while in violation
of this section or Section 3.

Section 3. A person, whether licensed or not,
whose blood contains 0.10% or more by weight of alcohol shall not
operate a vehicle upon a highway or other place open to the general
public, including an area designated for the parking of vehicles,
within the Township.

C.
Mopeds and motorcycles.

Section 1.016 of the Uniform Traffic Code, dated March
1981, entitled"Moped," is amended to read as follows:

Section 1.016 "Moped" means a two- or three-wheeled
vehicle which is equipped with a motor that does not exceed 50 cubic
centimeters piston displacement, produces 2.0 brake horsepower or
less, and cannot propel the vehicle at a speed greater than 30 miles
per hour on a level surface. The power drive system shall not require
the operator to shift gears.

Section 6.23(a) of the Uniform Traffic Code, dated
March 1981, entitled "Motorcycles: protective helmet standards," is
amended to read as follows:

Section 6.23(a) A person operating or riding
on a motorcycle, and any person less than 19 years of age operating
a moped on a public thoroughfare shall wear a crash helmet on his
or her head. Crash helmets shall be approved by the Department of
State Police.

Section 6.28 is hereby added to the Uniform Traffic
Code, dated March 1981, to read as follows:

Section 6.28(1) When a moped required to be
registered under this act is sold by a retailer to a general purchaser,
the certificate of registration shall be obtained in the name of the
purchaser. The application shall be signed by the purchaser of the
moped and shall be accompanied by a fee of $15. Upon receipt of the
application in approved form, the Secretary of State shall enter the
application upon the Secretary of State's records and issue to the
applicant a certificate of registration containing the decal for the
moped, the name and address of the owner and other information the
Secretary of State considers necessary. A moped shall not be required
to be insured in the manner specified for motor vehicles under Chapter
31 of Act No. 218 of the Public Acts of 1956, as amended, being §§ 500.3101
to 500.3179 of the Michigan Compiled Laws. The certificate of registration
shall be pocket size, shall accompany the vehicle, shall be legible
and shall be made available for inspection upon demand by a law enforcement
officer.

Section 6.28(2) A decal indicating that the
certificate of registration is in full force and effect shall be issued.
A registration certificate and decal shall not be issued earlier than
90 days preceding the commencement date of the new registration period.
Display of the decal shall be as prescribed by rule promulgated by
the Secretary of State.

D.
Safety belt usage required. Each driver and front
seat passenger of a motor vehicle operated on a street or highway
in the Township of Grosse Ile shall wear a properly adjusted and fastened
safety belt, except that a child less than four years of age shall
be protected by a child restraint system, as required by federal and
state law. Each driver of a motor vehicle transporting a child four
years of age or more, but less than 16 years of age in the front seat
of the motor vehicle, shall secure the child in a properly adjusted
and fastened safety belt. Enforcement of this article shall be accomplished
only as a secondary action whenever a driver of a motor vehicle has
been detained for a suspected violation of another Township ordinance
or state law. A person who violates this subsection is responsible
for a civil infraction and subject to a fine not to exceed $100.

The Township of Grosse Ile hereby amends Section 4.21
of the Uniform Traffic Code as adopted by Grosse Ile Township to read
as follows:

The Michigan Vehicle Code, 1949 PA 300, MCL
§§ 257.1 through MCL 257.923, as amended, is adopted
by reference (2000 Edition).
All references in the Michigan Vehicle Code
to local authorities shall mean the Township of Grosse Ile.
The penalties provided by the Michigan Vehicle
Code are adopted by reference; provided, however, that the Township
may not enforce any provision of the Michigan Vehicle Code for which
the maximum period of imprisonment is greater than 93 days.
All ordinances or parts of ordinances in conflict
herewith and with the provisions of the Michigan Vehicle Code are
hereby repealed only to the extent necessary to give this article
full force and effect.
The purpose of this article and the Michigan
Vehicle Code is to regulate the operation of vehicles, to provide
for the regulation and use of streets, highways and alleys and other
public and semipublic places within the Township of Grosse Ile and
to provide penalties for the violation of said code and ordinances.
A person may inspect or obtain a copy of the
Michigan Vehicle Code at the Grosse Ile Township Clerk's office located
at 9601 Groh Road, Grosse Ile, Michigan, during regular business hours.
The officer who issues a citation under this
article shall mark the local ordinance box on the citation and may
make reference to the offense being charged by writing the description
of the offense and/or by citing the last three numbers from the Michigan
Vehicle Code or by any other manner which would reasonably inform
the defendant of the charge.
