The alternate Planning Board member article shall apply to appointment,
terms, functions and powers of alternate members appointed to serve
on the Planning Board of the Village of Millerton.
As a result of recusals or absences by Board members, official
business may not always be able to be conducted and may delay or impede
adherence to required timelines. The use of alternate members in such
instances is hereby authorized pursuant to the provisions of this
article.
As used in this article, the following terms shall have the
meanings indicated:
An individual appointed by the Village Board of Trustees
to serve on the Village of Millerton Planning Board when a regular
member is unable to participate on an application or matter before
such Board.
An individual appointed by the Village Board of Trustees
to serve on the Village of Millerton Planning Board.
The Planning Board of the Village of Millerton.
A.
This article provides a process for appointing one alternate member
to the Planning Board. The individual would serve when a member is
unable to participate on an application or matter before such Board,
at the discretion of the Chair of such Board.
B.
The alternate member shall be appointed by the Village Board of Trustees
for a term of one year.
C.
The Chairperson of the Planning Board may designate the alternate
member to substitute for a member when such member is unable to participate
on an application or matter before the Board. When so designated,
the alternate member shall possess the powers and responsibilities
of such member of the Board. Such designation shall be entered into
the minutes of the initial Board meeting at which the substitution
is made.
D.
All provisions of state law relating to Planning Board member eligibility,
vacancy in office, removal, compatibility of office and service on
other boards, as well as any provision of a local law relating to
Planning Board members, shall also apply to alternate members.
E.
An alternate member shall attend all meetings of the Planning Board,
including work sessions, regular meetings and executive sessions with
regard to all matters which come before the Planning Board. The alternate
member shall have a right to vote only upon the inability of a regular
Board member to participate on a specific application before the Planning
board.
This article is hereby adopted pursuant to the provisions of
§ 10 of the New York State Municipal Home Rule Law and § 10
of the New York State Statute of Local Governments. It is the intent
of the Village Board of Trustees, pursuant to § 10 of the
New York State Municipal Home Rule Law, to supersede the provisions
of § 7-718 of the Village Law relating to the appointment
of members to the Village Planning Board.
