[Adopted 8-5-1998 by Ord. No. 98-138 (Ch. 5, Part 1, of
the 1984 Code of Ordinances)]
A certain document, two copies of which are on file in the Borough Office at 126 North Cherry Lane, Jacobus, Pennsylvania 17407, being marked and designated as the "International Plumbing Code, 1997," as published by the Building Officials and Code Administrators International, Inc., with the below-stated modifications, be and is hereby adopted as the Plumbing Code of Jacobus Borough, York County, Pennsylvania (hereinafter referred to as the "Plumbing Code"), in the Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of said International Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions and changes as prescribed in § 82-15, Supplemental specifications, of this article.
All ordinances or parts of ordinances in conflict with this
article are hereby repealed. In the event of any discrepancy between
the International Plumbing Code, 1997, and this article, or any rule,
regulation or exhibit promulgated under this article by the Jacobus
Borough Council, the provisions of this article or such rule, regulation
or exhibit shall apply.

The following sections of the International Plumbing Code, 1997,
are hereby revised as follows:
A.
Section 101.1. Section 101.1 shall specify "Jacobus Borough."
B.
Section 101.2 is revised as follows:

Section 101.2. Scope. The provisions of this code
shall apply to the installation of building sewers only, except that
all necessary inspections to determine compliance with other provisions
of this article are authorized.

C.
Section 106.5.2. The fee schedule is to be established by resolution
of the Borough Council.
D.
Section 106.5.3 is deleted.
E.
Section 108.4 is deleted.
F.
Section 108.5 is revised by adding the following: "... not less than
$200 nor more than $600."
G.
Section 305.6.1. Section 305.6.1 shall specify three feet zero inches
for pipeline depth.
H.
Section 306.2. Section 306.2 shall specify that, regardless of the
pipe type, a bed of six inches of crushed stone (1B, 2B or as approved
by the Plumbing Inspector) must be laid and pipe backfilled with 12
inches of stone above the pipe.
I.
Section 701.2. All occupied buildings within 250 feet of a sewer
line shall connect to the sewer.
J.
Section 702.3. Pipe for building sewers must be SDR35 PVC or service
weight cast iron.
K.
Section 704.1. The minimum slope for a four-inch pipe shall be 1/4
inch per foot and for six-inch pipe shall be 1/8 inch per foot.
L.
Section 708.2. Section 708.2 shall specify that any cleanout plugs
used outdoors shall be brass with countersunk heads.
M.
Section 708.3.2. Section 708.3.2 shall require cleanouts at intervals
of not more than 75 feet apart, and a cleanout shall be installed
at or near the existing or projected curbline of the property unless
the building trap assembly is within 15 feet of the curbline.
N.
Section 710.1. Add: Section 710.1. Minimum size of building sewer/drain
servicing a single-family structure shall be four inches in diameter
to first three-inch or larger stack.
O.
Section 712.4.1. Add: Section 712.4.1. Minimum size for underground
sanitary grinder pump force main pipe shall be 1 1/2 inches in
diameter.
P.
Section 1002.6. Section 1002.6 shall specify building (house) traps
are to be installed on every new or additional connection to the sanitary
sewer system.
Q.
Section 1101.3. Add: Section 1101.3 shall specify that roof gutters,
leaders and conductors are prohibited to connect to the sanitary sewer
system.
R.
Section 1104.3. Add Section 1104.3 as follows: "Floor drains below
grade are prohibited to be connected to the building sanitary sewer
systems unless specifically waived by the Authority."
S.
Section 1111.2. Add: Section 1111.2 shall specify that building subdrains
and foundation-type area drains (footer drains) are prohibited to
connect to the sanitary sewer system.
T.
Section 710. Section 710.4 is added as follows:

Section 710.4. Minimum size of building sewer/drain
servicing a commercial establishment (including apartment buildings
with more than two apartments) connecting to an existing lateral stub
shall be equal to the size of the lateral stub provided. Where no
lateral stub exists, the minimum size of the required tap and building
sewer shall be six inches in diameter.

U.
Section 1003. Section 1003.14 is added as follows:

Section 1003.14. Food waste grinders may discharge
into five-hundred gallon or larger grease interceptors. Commercial
dishwashers are required to discharge into grease interceptors with
a minimum distance of 10 feet between the dishwasher outlet and the
inlet of the grease interceptor.

V.
Section 1003. Section 1003.15 is added as follows:

Section 1003.15. Beauty salon/barbershop-type establishments. Beauty sinks shall discharge into a hair or solids-type interceptor.

Section 1003. Section 1003.16 is added as follows:

Section 1003.16. Animal grooming establishments. Washtubs/sinks shall discharge into a hair or solids-type interceptor.

The Jacobus Borough Council may adopt regulations by resolution
establishing additional procedures and examples to effectively administer
the Plumbing Code outlined as follows:
A.

PLUMBING INSPECTOR
Definitions. As used in this Plumbing Code, the following terms shall
have the indicated meanings:
A person regularly employed by and engaged in the plumbing
business conducted by a master plumber, duly licensed as an apprentice
in accordance with the provisions of this code.
A five-member Board appointed by the Jacobus Borough Council
and known as the "Jacobus Borough Sewer Authority."
This Plumbing Code, as amended, together with the 1997 International
Plumbing Code and any rule or regulation promulgated hereunder by
the Borough.
A person to whom a currently valid journeyman plumber's
license has been issued in accordance with the provisions of this
code.
A person not otherwise licensed or registered under the provisions
of the code and employed in the performance of plumbing work by a
master plumber.
A person to whom a currently valid master plumber's
license has been issued by Springettsbury Township or the City of
York, York County, Pennsylvania, or Class 1 or 2 cities as stated
in the York City Plumbing Code.
A copy of the 1997 International Plumbing Code, appropriately
amended to be an official copy of the code.
A person hired by the Jacobus Borough Sewer Authority to
perform the duties assigned in the code.
B.
Plumbing permits.
(1)
Application; issuance. No sewer lateral installation shall be undertaken
unless and until a registered and licensed master plumber proposing
to undertake the same shall have filed with the Plumbing Inspector
or Authority an application for a plumbing permit for such work and
until the necessary fees have been paid therefor, and a plumbing permit
shall have been issued therefor. The owner of the said property may
pay the necessary fees in advance of the licensed master plumber picking
up the permit to perform the work. No permit shall be issued until
plans and specifications showing the proposed work in reasonable detail
shall have been submitted to the Plumbing Inspector, and it has been
determined from examination of such plans and specifications that
the proposed work will conform with the provisions of the code. If
a permit is refused, written notice thereof shall be provided to the
applicant, who may submit such revised plans and specifications as
are necessary to obtain approval. If, in the course of the work, it
is found necessary to obtain approval to make any change from the
plans and specifications on which a permit has been issued, amended
plans and specifications shall be submitted, and a supplementary permit
shall be issued to cover the change after the same conditions required
to secure the original permit have been satisfied.
(2)
Fees. Fees shall be set from time to time by resolution of the Authority.
C.
Condemned equipment. The Plumbing Inspector shall condemn any plumbing
material or equipment which is so worn, damaged, defective or constructed
as to constitute a sanitary or safety hazard, and such condemned material
or equipment shall not be reused for plumbing purposes. Where, in
the opinion of the Plumbing Inspector, condemned material or equipment
shall be destroyed to prevent its reuse, he may order such destruction.
D.
Procedure in event of sewer stoppage. In the event of a stoppage
of a main building drain or sewer, the owner or tenant shall first
contact a plumber to ascertain the location of the stoppage, and in
the event that the public sewer is the problem, the plumber in turn
shall notify the Authority's office.
E.
Inspection of building before connection to sewer. Before any building
shall be connected with the sanitary sewerage system, the plumbing
system thereof shall be inspected and approved by the Plumbing Inspector.
The Plumbing Inspector may order revision, alteration and correction
to the plumbing system so that the plumbing system shall conform,
both in construction and manner of use, to the provisions of the Plumbing
Code.
F.
Procedure upon removal of building. When any building is removed
or any drainage or sewer system is abandoned or dismantled or removed,
the sewer connection shall be disconnected at the curb or property
line and properly sealed, plugged or capped and inspected by the Plumbing
Inspector.
G.
Waiver of authority liability prerequisite to permit issuance of
structures below grade. When a permit is issued for a building having
plumbing fixtures in the basement or a section of the building below
grade construction, the owner shall be required to sign a written
agreement or waiver upon a form furnished by the Authority in the
hands of the Plumbing Inspector, releasing the Authority from any
damage that may result from this area being flooded by the stoppage
or backflow of sewers. In areas where stoppage or backflow is prevalent,
the building shall be provided with a backwater valve or check valve.
I.
Enforcement.
(1)
Any portion of a plumbing system found by the Plumbing Inspector
to be unsanitary as defined herein is hereby declared to be a nuisance.
(2)
Whenever it is brought to the attention of the Authority that any
unsanitary conditions exist or that any construction or work regulated
by this code does not meet the code, the Authority may request an
investigation by the Plumbing Inspector, who, upon determining such
information to be fact, shall order any person using or maintaining
any such condition or responsible for the use or maintenance thereof
to repair, alter, change, remove or demolish the same as may be considered
necessary for the proper protection of life, health or property. Every
such order shall be in writing, addressed to the owner, agent or person
responsible for the premises in which such conditions exist and shall
specify the date or time for compliance with such order.
(3)
Refusal, failure or neglect to comply with such notice or order shall
be considered a violation of this code.
(4)
When any plumbing system is maintained in violation of this code
and in violation of any notice issued pursuant to the provisions of
this section, or where a nuisance exists in any building or on a lot
on which a building is situate, the Plumbing Inspector shall institute
any appropriate action or proceeding in any court of competent jurisdiction
to prevent, restrain, correct or abate the violation or nuisance.
J.
Plumbing Inspector.
(1)
Office created; assistant. The offices of Plumbing Inspector and
Assistant Plumbing Inspector are hereby created. The Plumbing Inspector
shall be hired by the Authority to serve at its pleasure for such
compensation as such Authority shall from time to time determine.
(2)
Duties. The duties of the Plumbing Inspector(s) are as follows:
(a)
Maintain public office hours within the Borough necessary to
efficiently administer the provision of the code and amendments thereto.
(b)
Require submission, examine and check plans and specifications,
drawings, descriptions and/or diagrams necessary to show clearly the
character, kind and extent of work covered by applications for a permit
and, upon approval thereof, issue the permit applied for.
(c)
Keep a permanent, accurate account of all fees for permits issued
and other monies collected and received as provided by this code and
other Authority codes, regulations or standard details, the names
of the persons upon whose account the fees were paid, the date and
amount thereof, together with the location or premises to which they
relate.
(d)
Enforce the provisions of this code in a manner consistent with
the intent thereof and inspect all plumbing and drainage work authorized
by any permit to assure compliance with provisions of this code or
amendments thereto, approving or condemning such work, in whole or
in part, as conditions require.
(e)
Issue, upon request, a certificate of approval for any work
approved.
(f)
Condemn and reject all work done or being done or materials
used or being used which do not in all respects comply with the provisions
of this code and amendments thereto.
(g)
Order changes in workmanship and/or materials essential to obtain
compliance with all provisions of this code.
(h)
Investigate any construction or work regulated by this code
and issue such notices and orders as deemed necessary.
(i)
Keep a complete record of all the essential transactions of
his office.
(3)
Conduct of plumbing business.
(a)
Plumbing permits will only be granted to a master plumber, duly
licensed in Springettsbury Township or the City of York or Class 1
or 2 cities, as stated in the York City Plumbing Code, in person,
after the filing and payment of all information, plans, specifications
and fees required by this code or any resolution of the Authority.
(b)
A journeyman or master plumber must be responsible for all plumbing
work performed for all sewer lateral connections in the area served
by the Authority.
(4)
Display of certificate or cards. Every master plumber, journeyman
plumber and apprentice plumber shall have in their possession, at
all times when engaged in plumbing work, a certificate of license
card, showing that such workman is the holder of a license issued
pursuant to this section, and such workman shall exhibit the same
upon request. The original certificate of license shall be displayed
for all at the place of business at all times, and a photocopy at
the work sites at all times for which work is to be performed by his
or their company.
K.
Acceptable materials.
(1)
Sampling manholes. Sampling manholes shall be four feet inside diameter,
with a minimum depth of 40 inches and a maximum depth of 122 inches
from grade to invert, meeting the requirements of ASTM C-478 specifications,
as manufactured by Monarch Products Company, Inc., York Haven, Pennsylvania
(or approved equal), and as shown on Drawing MH-4C herein.[1] Each sampling manhole shall be provided with a twenty-four-inch-by-twenty-four-inch
(clear opening) aluminum access door, similar in all essential respects
to type APS, as manufactured by U.S. Foundry and Manufacturing Corporation
and shown on Drawing MH-4D herein.[2]
(2)
Sewer pipe saddles. New connections to the sewer system shall be
made to the sewer main; no penetrations of existing manholes will
be permitted without specific written approval of the Sewer Authority.
Connections to sewer mains shall be effected by means of a pipe saddle
with gasketed bell designed for use with SDR35 PVC pipe. Sealtite
Model "H" tee sewer saddle as manufactured by the General Engineering
Co., Frederick, MD, or approved equal.
(3)
Transition couplings. Where joints must be made between Schedule
40 and SDR35 PVC pipe, a fitting designed especially for this purpose,
such as the No. G657 four-inch DWV by four-inch SDR35 coupling as
manufactured by Plastic Trends, Inc., shall be used.
Nothing in this article or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed as cited in § 82-14 of this article, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
This article shall take full force and effect 10 calendar days
after this date of final passage and approval.

Any person who shall violate the provisions of this article
shall be subject to a summary criminal proceeding before the Magisterial
District Justice as provided by the Pennsylvania Rules of Criminal
Procedure, as may be amended from time to time. Upon a finding of
a violation, a fine of not less than $450 nor more than $1,000, plus
costs of prosecution, including court costs and reasonable attorney
fees incurred by the Borough to prosecute the violation, shall be
imposed, and such person may be subject to imprisonment of up to 15
days in the event such fines and costs are unpaid. Each day that such
violation(s) continues shall be a separate violation of this article.
