indicated in each case, shall slow down or stop the vehicle as required
by § 3323(c) of the Vehicle Code and then yield the right-of-way
as required by that subsection of the Vehicle Code.

shall be operated on any property owned by the Township or any other
public agency or instrumentality within the Township without the permission
of the property owner and a permit from the Board of Supervisors of
the Township.

The Chief of Police is authorized to designate as play highways,
whenever he deems that action advisable, and for whatever period of
time directed by him, any part of any street in the Township, where
sledding and coasting shall be permitted. That play highway shall
be set apart for the purpose under the direction of the Chief of Police.
3.
No person shall drive any motor vehicle upon any play highway at
any time when that street shall be designated as a play highway, except
in case of emergency, with special permission of the Chief of Police
or of the police officer in charge, who shall first clear that play
highway of all persons using it for the purpose for which it was set
aside. Any person who violates any provision of this subsection shall,
upon conviction, be sentenced to pay a fine of $25 and costs.

It shall be unlawful for any person to operate a snowmobile on any
highway, street or road in the Township other than as provided above,
provided that nothing in this section shall prohibit any person from
operating a snowmobile on any other street in the Township:
A.
As authorized by § 7721 of the Vehicle Code for emergency
and bridge crossings and for direct crossing of streets or two-lane
highways; or
B.
For special snowmobile events where authorized in advance and the
street is blocked off as provided in § 7723 of the Vehicle
Code. Any person who violates any provision of this section shall
be subject to the penalties prescribed in § 7752(a) of the
Vehicle Code.

1.
Short Title. This section shall be known as the "Ralpho Township
Engine Suppression/Brake Retarder/Engine Brake Ordinance."
2.
Legislative Intent. The Ralpho Township Supervisors find as a fact
that the operation of an engine brake or an engine suppression device
or a compression brake on a gasoline- powered or diesel-powered motor
vehicle not equipped with exhaust mufflers, or equipped with defective
or modified exhaust mufflers, so as to create excessive noise through
the use of said engine brake or engine suppression device or a compression
brake, adversely affects the public health, safety and welfare of
the residents of the Township of Ralpho and, therefore, is a nuisance
in fact.
3.
Engine Brakes Prohibited. No gasoline-powered or diesel-powered motor
vehicle shall be operated on the streets, roads, alleys or highways
listed below within the Township of Ralpho, Northumberland County,
Pennsylvania, utilizing, in said operation, an engine brake, engine
suppression device or compression brake, without exhaust mufflers,
or with defective or modified exhaust mufflers permitting excessive
noise to be created by said motor vehicle.
4.
Streets. The streets subject to this prohibition shall be as follows:
A.
S.R.54 from Hillside Avenue north to 240 feet north of Circle Drive
for northbound traffic.
B.
S.R.54 from 280 feet south of Mill Street south to Hillside Avenue
for southbound traffic.
C.
S.R.487 from 200 feet east of Hillside Avenue, east to 60 feet east
of Clair Street for eastbound traffic.
D.
S.R.487 from 60 feet east of Clair Street, west to 240 feet west
of Spruce Street for westbound traffic.
E.
S.R.2008 from 300 feet east of North Scenic Drive, east to 100 feet
west of S.R.54 for eastbound traffic.
5.
Emergency Situations. This section shall not apply to emergency driving
situations requiring the utilization of an engine brake to protect
the safety and property of the residents of the Township of Ralpho,
other motor vehicle operators, pedestrians and the operator and passengers
of the motor vehicle involved in said emergency situation.
6.
Penalty. Any person, firm, corporation or organization violating
any of the provisions of this section shall, upon summary conviction
before a district magistrate having jurisdiction, be sentenced to
pay a fine of not less than $50 nor more than $300 and costs of prosecution,
and in default of the payment thereof, shall be sentenced to undergo
imprisonment in the Northumberland County Jail for a period not to
exceed 10 days.
