The purpose of this Part is to allow the creation of a special lot through a simplified procedure.

Only a final plan submission is required for a special minor subdivision. The developer or subdivider shall file five copies of the subdivision plan with the requisite fee and application form with the Commission. The developer or subdivider shall submit evidence of compliance with the Pennsylvania Sewage Facilities Act requirements on sewage disposal. The developer or subdivider will submit a request for a variance as outlined in Part 8 of this Chapter.

The Planning Commission will review the plans and approve or disapprove the same within 60 days, or it shall be deemed the plan has been approved. The review will basically be concerned with the following items:
A. 
That the future street pattern of the area will not be adversely affected by the proposed subdivision.
B. 
Lot Frontage. All lots shall have access to an approved street. Single lots which do not have access to a street may be created under Part 9 of this Chapter provided:
(1) 
The lot created will not be further subdivided.
(2) 
The original lot will not be further subdivided and will meet the frontage requirements of the district in which it is located, plus the 16 feet required for the driveway to the newly created lot.
(3) 
The newly created lot will have a driveway to an approved street and this driveway will become a part of the newly created lot.
(4) 
The newly created lot meets all other requirements of this Chapter and the Zoning Ordinance [Chapter 27].
(5) 
The original lot will meet all the requirements of the existing Zoning Ordinance [Chapter 27] and this Chapter.
(6) 
There be adequate deed restrictions to enforce the requirements of this Chapter.
C. 
That the development does not create problems in the design of future utilities.
D. 
Other factors such as geology, terrain, location in floodplain, etc.
E. 
Developer or subdivider shall be required to install a driveway comprised of a four-inch AASHTO #57 aggregate stone base course followed by a surface treatment, all per PennDOT Specifications Form 408. The cartway width shall be 16 feet. No storm drainage shall enter onto adjacent properties.
F. 
The original lot was created prior to November 20, 1988.

After making any necessary changes, the developer or subdivider may resubmit the plan for approval.

If the plan is found to conform to this Chapter, the Planning Commission shall approve and sign the plan and submit it to the Board of Supervisors for approval. After approval by the Board of Supervisors, the subdivider shall record the plan in the Office of the Northumberland County Recorder of Deeds within 90 days and furnish the Board of Supervisors proof thereof.

All special minor subdivision plans shall conform to the following:
A. 
Title Block. The title block shall show the name of the special minor subdivision, municipality in which located, name and address of the owner, address and seal of the engineer or surveyor and the date of preparation.
B. 
Location Sketch. A location sketch shall be shown, north oriented to the top of the drawing, showing the special minor subdivision in relationship to contiguous roads and land. A USGS map at a scale of one inch equals 2,000 feet may be used as source information. A tract map shall also be provided on a scale the same as the Northumberland County tax assessment maps and shall show the proposed special minor subdivision and residue land.
C. 
Plan Information. Shall be as outlined in the applicable preliminary plan and final plan requirements Sections of this Chapter, as determined by the Planning Commission and Board of Supervisors.
D. 
Accompanying data shall be submitted as required by the applicable Sections of this Chapter, as determined by the Planning Commission and Board of Supervisors.

Any additional subdivision of a tract from which a special minor subdivision has already been formed shall be deemed to be a major subdivision and shall follow those requirements and procedures.
